Recommended Motion: THAT the proposed phasing plan amendment for 44 Ranch Subdivision be approved, in accordance with Article 4-7(2) of the Missoula City Subdivision Regulations. Timeline: City Council’s Referral to committee: February 1, 2010 PAZ Committee Action: February 3, 2010 Action Item City Council Action: February 8, 2010 (Consent Agenda or Committee Reports) Deadline: Item does not carry a statutory deadline Background: The Office of Planning and Grants has received a request from WGM Group on December 10, 2009, to amend the approved phasing plan for 44 Ranch Subdivision (Attachment 44 Ranch Subdivision was approved by the Missoula City Council with 19 phases on May 16, 2005, subject to 30 conditions of approval (Attachment The phasing plan was subsequently amended on October 2, 2006 (Attachment Phases 1-5 have been filed; the phasing plan specified a Phase 6 final plat filing deadline of December, 2009. The applicant requests the following amendments (Attachment 1. Extend the filing deadline by 5 years for Phases 6-21. The applicant states that this is requested due to significantly reduced lot sales than were anticipated 3 years ago. 2. Amend a portion of Phase 8 to be Phase 6A. The applicant states that this is requested because it is more economical for the developer to build Phase 6A. 3. Amend Phase 7 to be Phase 6B, and amend Phase 6 to be Phase 7. The applicant states that this is requested because it is desirable to have Barbed Wire Drive constructed along the south side of the park for access to the park, mowing and maintenance of the park, and to maximize the benefits of the park construction amenities for the development. The design of the phases, including lot and road configuration, number of lots, and lot sizes, will not be changed from the phasing plan approved on October 2, 2006. The requested phasing plan amendment was described in an agency comment memo provided to City Engineering, City Fire, City-County Health, and City Parks on December 18, 2009. No adverse comments were received regarding the proposal. ---PAGE BREAK--- Staff Recommendation: Staff recommends approval of the proposed phasing plan amendment for 44 Ranch Subdivision, in accordance with Article 4-7(2) of the Missoula City Subdivision Regulations. Applicable Subdivision Regulations: Subdivision phasing, including amendment of proposed phasing plans, is discussed in Missoula City Subdivision Regulations Article 4-7(2)(A-C): PHASING: Nothing in this section prohibits the phasing of a project over a period which exceeds three years if the subdivider provides a detailed plan for the future phases of the subdivision and the proposed timing of the phasing. The governing body reserves the right to impose additional conditions which require compliance with regulations which exist at the time that each phase is brought before the governing body for review. The applicant subdivider may propose, as part of the preliminary plat approval process, to delineate on the preliminary plat two or more final plat filing phases and to establish the schedules for submission of the phases; and, When phasing is not indicated on the preliminary plat, the final plat shall be submitted for the entire area shown on the preliminary plat. If the applicant desires to establish phases following approval of the preliminary plat, a new preliminary plat delineating the phases and establishing the schedule must be submitted and approved according to these Regulations. Modifications to an approved phasing plan or schedule shall require the approval of the governing body. Final plats of subdivision approved for phased development shall be filed sequentially in accordance with the approval. Financial Implications: None foreseen Attachments: A.
