DRAFT 06/04/2010 ORDINANCE NUMBER AN ORDINANCE OF THE MISSOULA CITY COUNCIL AMENDING MISSOULA MUNICIPAL CODE TITLE 2, ENTITLED “ADMINISTRATION AND PERSONNEL”, CHAPTER 2.32 ENTITLED “POLICE DEPARTMENT” BY ADOPTING AND ESTABLISHING NEW SECTION 2.32.060 ESTABLISHING PURSUANT TO STATE LAW THAT MISSOULA POLICE OFFICERS MAY EXERCISE POWERS OF ARREST WITHIN FIVE MILES OF THE MISSOULA CITY LIMITS. BE IT ORDAINED BY THE MISSOULA CITY COUNCIL THAT TITLE 2, CHAPTER 2.32, SECTION 2.32.060 BE ADOPTED AS FOLLOWS: Section 1. 2.32.060 Authority to arrest – extension of jurisdiction outside city limits Pursuant to MCA 7-32-4301 this section authorizes Missoula city police officers jurisdiction and authority to enforce the criminal laws of the state and make arrests within five miles of the city limits. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The council hereby declares that it would have passed this ordinance and each section subsection, sentence, clause, phrase, and words thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or words have been declared invalid or unconstitutional, and if for any reason this ordinance should be declared invalid or unconstitutional, then the remaining ordinance provisions will be in full force and effect.
