City of Missoula, Montana Item to be Referred to City Council Committee Committee: Budget Committee of the Whole Item: Resolutions amending protest tallies for Road District 1 and Park District 1 Date: September 24, 2010 Prepared by: Marty Rehbein, City Clerk Initiated by: Bruce Bender, CAO Action Required: Adopt two resolutions Recommended Motion: Adopt a resolution of the city council of the city of Missoula, Montana, amending resolution no. 7563 which created the city of Missoula Road District Number 1 and levied and assessed the lots and parcels within such district for the costs of certain services and improvements, to reflect the total number of written protests received regarding the creation of such district; and providing for other matters properly relating thereto. Adopt a resolution of the city council of the city of Missoula, Montana, amending resolution no. 7564 which created the city of Missoula Park District Number 1 and levied and assessed the lots and parcels within such district for the costs of certain services and improvements, to reflect the total number of written protests received regarding the creation of such district; and providing for other matters properly relating thereto. Timeline: Referral to committee: September 27, 2010 Committee discussion: September 29, 2010 Public hearing (if necessary): n/a Deadline: October 4, 2010 Background and Alternatives Explored: On Friday, September 17, a property owner who had protested the Special Districts reviewed the roster of protests and notified the City Clerk that their protest was not registered on the roster. Upon review by the City Clerk’s office, it was discovered that a batch of protests of had not been counted. As a result of this error, the Mayor and I ordered a review of the count to be completed by staff who had not performed the original count. This review consisted of comparing the received original protest forms with the roster of protests to verify if the form had been reviewed. Staff have updated the protest tallies to reflect the protests that were not originally counted. ---PAGE BREAK--- The City’s bond counsel, Roy Koegen, has determined that a resolution correcting the protest level will need to be acted upon by the City Council.
