PROPOSED AMENDMENTS TO TITLE 12 MISSOULA MUNICIPAL CODE TITLED MCC 12.22 PARKING FACILITIES SUMMARY PURPOSE OF AMENDMENT: The purpose of this amendment to MMC Title 12 is to pull parking facility standards from several different information sources and place them under a single ordinance. This new ordinance will be placed in title 12 and enforced by The City Engineering Division as it was in the past. The new code will result in a much more user friendly document allowing the developers and their design consultants easier access to the requirements and create a consistency in interpretation of the standards which should eliminate confusion and discrepancy in design. PUBLIC REVIEW: I will have this posted on the City web page then contact the engineering and architectural firms that use these standards on a regular basis and ask them to comment. ADDITIONAL CITY ENGINEERING STANDARDS AND SPECIFICATIONS: Our existing standard drawings and specifications will be revised to provide more detailed information regrading the new standards set forth in this proposed ordinance. SOURCES OF THE STANDARDS INCLUDED: The following documents were used sources for the standards included in this proposed ordinance: 1. Title 20: Newly adopted Zoning Ordinance. Most of the parking facility engineering design elements that existed in the previous Title 19 document were removed from title 20 to be placed in Title 12. Many of the elements in 12 are referenced to applicable standards in title 20 as are many elements in 20 refer to title 12. Previously there were several important conflicts between Title 19 standards and ADA, Title 12 and other engineering standards and these are resolved with this proposed ordinance. 2. Title 12: Elements from several sections in title 12 have been referenced in 12:22 such as right-of-way improvements, fees and construction requirements related to parking facilities that make the use of title 12 much more user friendly. 3. Americans with Disabilities Act (ADA) (28 CFR part 26): An entire section of 12.22 addresses ADA issues. Previously, general requirements were adopted in Title 15 under building standards. ADA standards in 12.22 are much more specific to parking facilities and will simplify incorporation of the most resent standards in the developments. We monitor changes in ADA so we will be able to update title 12 as needed. 4. Missoula City County Air Pollution Control Program: Many of the standards in 12:22 were taken directly from the Air Pollution Control Program documents. 5. Existing City Engineering Design Standards, Specifications and Adminstr4ative Policies: Many of the elements included in 12.22 previously existed in various Engineering Division documents including standard drawings and administrative policies. SUMMARY OF IMPORTANT ELEMENTS IN THE PROPOSED AMENDMENT: The following is a summary of the elements within 12.22 that represent a change or addition to previous existing standards. ---PAGE BREAK--- Chapter 12.22.50 General Requirements 1. A-F, H, T,U Are taken directly for existing standards or new standards in title 20 and represent no change 2. G Clarifies a section in 12.12 which requires a driveway to be removed when the use is discontinued such as when a garage is converted living space and the remaining parking space is in the setback or right-of-way 3. I This is new and based on situations where new development can be impactive to the condition and lifespan of the improvements in the public right of way. The best example of this is the drive through car washes such as the one at 3rd and Russell dragging a considerable amount of water onto Russell creating an icing problem and accelerating freeze thaw cycles. 4. J-R Are clarifications of existing standards and represent no significant changes 5. S Clarifies existing standards for using the alley for part of the access to parking faculties Chapter 12.22.090 ADA Requirements. 1. All standards included in this section reflect the latest federal ADA requirements and there are no significant changes except below. 2. 12.22.090 B 2 new requirement This represents a new change in ADA which allows a parking lot with 4 or fewer spaces to install an accessible parking space but does not require this space to be reserved for ADA exclusively. This is a big change and should be a significant help with establishing parking for small businesses. Chapter 12.22.100, 12.22.110, 12.22.120. 1. Refer to existing permitting, inspection, compliance with construction standards. There are no changes to previous or existing standards. Chapter 12.22.130 Single Family Residential Parcels 1. A-E Follow existing standards plus several new standards required in Title 20 for access locations 2. F Clarifies abandonment of an existing parking space located within the setback when the use within the building envelope is eliminated. 3. G New requirement Defines when a change in the parcel will result in parking up- grades which bring existing parking to present standards such as paving. This is new but we feel it is necessary to reduce air quality issues whenever the opportunity arises. We quantified it by limiting this requirement to change of use, increased parking demand or significant remodels (greater then 200sf) so it does not affect small remodels or changes. 4. H New requirement. Requires SFRs with alley access to pave the portion of the adjacent to their parcel. This was brought up in PWC several years ago but no action was ever taken. 5. I New requirement Places certain requirements on driveways to townhouses as spelled out in Title 20 Chapter 12.22.130 Duplex Parcels ---PAGE BREAK--- 1. Duplex lot is defined in 12.22.040 which includes modification to existing structure, and/or an additional structure that results in a parcel with 2 dwelling units. 2. A-E, Follow existing standards plus several new standards required in Title 20 for access locations 3. F Requires all existing and new parking to be upgraded to present standards when a SFR is converted to a duplex lot. This has been done in the past through policy but it should be in MCC 4. G Requires alley paving. This has been required through policy for many years but should be in MCC Chapter 12.22.150 Multifamily Parcels 1. A-C, F, Follows existing standards plus several new standards for parking facility locations and access points as set forth in Title 20 2. D , E Requires curbing and drainage improvements and these improvements must be designed by a civil engineer. This has been required through policy for many years but should be in MCC 3. G New requirement If the alley is used as the access to a multifamily parking facility requires the entire alley to be paved from each intersecting street. Presently they only are required to pave to the nearest street and we feel this alley paving requirment is necessary as one of the most common complaints we hear is the increased traffic and dust due to multifamily development along primarily residential development. 4. H New Relaxes some of the requirements for multifamily parcels with 3 or less dwelling units. 3 dwelling unit parcels were chosen due to the ADA requirements applicable to multi-dwelling parcels with 4 or more living units and the design standards that are needed to meet ADA. 5. I-J Refer to shared, offsite, bicycle, and parking as spelled out in Title 20 Chapter 12.22.160 Commercial and Industrial Parcels 1. A, B, Follow existing standards plus several new standards for parking facility locations and access points as set forth in Title 20 2. C,D Requires curbing and drainage improvements which must be designed by a civil engineer. This has been required through policy for many years but should be in MCC 3. E New requirement Requires commercial and industrial parking facilities to be designed to prohibit vehicles from backing out of the parking into to street. This has been required through policy for many years but should be in MCC 4. F New requirement See 12.22.150 above 6. G New Relaxes some of the requirements for commercial/industrial parcels with 4 or less parking spaces. Parcels with more than 4 parking spaces have ADA requirements that require more stringent design standards. 5. H-J New requirement Clarifies ADA requirements for shared and offsite parking as well as access to transit stops if used for parking reductions per title 20 6. L,M Refer to bicycle and parking 7. N New requirement Prohibiting vehicles from accessing loading docks by backing in off of a public street. 8. O Stacking lane requirements per title 20
