Attachment #1 Planning Board Recommendations 2012 North Avenue Rezone Planning Board Recommendation: On Tuesday, May 18, 2010, with nine members present, the Missoula Consolidated Planning Board voted unanimously to recommend denial of the applicant’s request to rezone property located at 2012 North Avenue from RM2.7 (residential multi-dwelling) to C2-4 (Community Commercial--Intensity Designator This property is legally described as Lots 25 and 26 Block 1 of Car Line Addition No. 2 and Lot 12 Block 12 of South Side Addition, located in Section 29 of Township 13 North, Range 29 West, P.M.M. A summary of the Board’s discussion on the rezoning proposal can be found following the recommended motion. Planning Board’s Recommended Motion: THAT the request to rezone property legally described as Lots 25 and 26 Block 1 of Car Line Addition No. 2 and Lot 12 Block 12 of South Side Addition, located in Section 29 of Township 13 North, Range 29 West (see Map P.M.M. from RM2.7 (residential multi-dwelling) to C2- 4 (Community Commercial – Intensity Designator = be denied based on the findings of fact in the staff report. Planning Board Discussion: Planning Board agreed with staff’s recommendation on the motion to deny the proposed rezoning. The Board inquired into the intensity of uses that would be allowed under the proposed C2-4 zoning, and the distinction between uses allowed in C2-4 and C1-4, the latter being the zoning district of the adjacent Hellgate Tool parcel. They also asked about the level of residential development potential considering existing RM2.7 zoning on the parcel. Planning Board questioned the appropriateness of either commercial district in the same block as the requested rezoning, and noted a concern over commercial zoning creeping into the block. They acknowledged some level of historic commercial use on this property, but were unsupportive of a commercial rezoning that would permit an array of uses more intense than the small-scale auto repair that currently occurs on the property.
