Grantor property is more particularly described as follows: Lot 3 of GROVE STREET ADDITION, a recorded subdivision recorded in Missoula, County, Montana; located in the Southeast One- quarter of Section 19, Township 13 North, Range 19 West, P.M.M. Grantee property is more particularly described as follows: Lot 2 of GROVE STREET ADDITION, a recorded subdivision recorded in Missoula, County, Montana; located in the Southeast One- quarter of Section 19, Township 13 North, Range 19 West, P.M.M. It is the understanding and intention of the parties hereto to create a private access easement across Lot 3 for the use and benefit of Lot 2. The easement is for the express purpose of providing to Grantee (Lot their successors and assigns, a private access easement more particularly described as follows: An easement over and across the easterly portion of said Lot 3 and more particularly described as the "20 foot Private Access Easement/Utility Easement" as shown on said plat of Grove Street Addition. The easement is subject to the following conditions and limitations: The easement shall be for the specific purpose of providing area for private access to the property owned by Grantee (Lot 2) as referenced herein. ---PAGE BREAK--- Page 2 of 3 The Grantor hereby specifically reserve unto themselves and their agents, servants and contractors and their successors and assigns, the right to cross over, on and upon the lands herein described whenever in the usual course of business it may become necessary and advisable or convenient for the Grantor, their agents, servants, contractors, successors or assigns to do so. This reservation unto Grantor is for all purposes as may be necessary and convenient; however, that such use of said easement shall not operate to exclude Grantee from the use and enjoyment of the rights granted herein. In using the easement, Grantee shall comply with all applicable laws, rules and regulations of any public authority relating to such use and Grantee shall use reasonable care to safeguard the property of Grantor. As noted, the easement created herein is intended to be permanent and shall run with and inure to the nonexclusive benefit of Grantee, Grantee property described herein and the successors and assigns in and to some or all of said property. The Grantor hereby acknowledges that they are the lawful owner(s) and seized of the real property over which and upon the easement described herein is granted, and that they have good and lawful right and authority to grant said easement. Binding Effect. Grantor property is more particularly described as follows: Lot 4 of GROVE STREET ADDITION, a recorded subdivision recorded in Missoula County, Montana; located in the Southeast One- quarter of Section 19, Township 13 North, Range 19 West, P.M.M. Grantee property is more particularly described as follows: Lot 2 of GROVE STREET ADDITION, a recorded subdivision recorded in Missoula County, Montana; located in the Southeast One- quarter of Section 19, Township 13 North, Range 19 West, P.M.M.
