RESOLUTION NUMBER A RESOLUTION OF THE MISSOULA CITY COUNCIL REVISING RESOLUTION NO. 6193 THE SEWER USE FEE STRUCTURE AND INCREASING SANITARY SEWER RATE FOR USE OF THE MISSOULA CITY SANITARY SEWER SYSTEM. BE IT RESOLVED THAT THE MISSOULA CITY COUNCIL DIRECT STAFF TO WORK WITH MOUNTAIN WATER COMPANY AND OTHER WATER UTILITIES SERVING MISSOULA RESIDENTS CURRENTLY CONNECTED TO THE MUNICIPAL WASTEWATER SEWER SYSTEMS, AND IDENTIFY THOSE SEWER CUSTOMERS IN SINGLE FAMILY RESIDENCE, MOBILE HOMES AND MULTIFAMILY RESIDENTIAL CATEGORIES WHO HAVE METERED WATER HOOKUPS AND BASE THEIR SEWER RATES ON ACTUAL WATER USAGE RATHER THAN THE FLAT RATE STRUCTURE WHEN FEASIBLE. BE IT FURTHER RESOLVED THAT THE MISSOULA CITY COUNCIL DIRECTS STAFF TO RECOGNIZE IMPROVEMENTS IN WASTEWATER PRETREATMENT TECHNOLOGY AND ALLOW RATES FOR RESTAURANTS AND FOOD SERVING ESTABLISHMENTS TO BE ADJUSTED BASED ON STRENGTH OF LOADING CHARACTERISTICS WHEN USING APPROVED ADVANCED TECHNOLOGIES TO REDUCE BOD, TSS, N&P AND GREASE AND THE COST OF MONITORING. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MISSOULA THAT THE FOLLOWING SANITARY SEWER USE FEE SCHEDULE BE ADOPTED BY THE CITY OF MISSOULA. Section 1. Definitions. Sewer Use Classification. A Septic Tank Effluent Pumping (STEP) system can be used within any of the aforementioned user classifications. The non-restaurant portions of hotels and motels with restaurants and bars will be charged at the 200 user classifications charge where separate water use volumes for the restaurant and the hotel or motel can be verified. It shall be the property owner’s responsibility to install meters or otherwise verify the separate water use in a manner accepted by the City. Section 2. Sewer Use Fee. Multiple Uses in One Building. In the event there is more than one type of business or office of any nature located within one building and separate water use cannot be determined for each use, the sewer use charge for the entire building will be determined based on the use charge for the business with the higher strength per classification. It is the property owner’s responsibility to install meters or otherwise verify the separate water use in a manner acceptable to the City. In the event that multiple family residential class uses are in the same building as commercial uses and water uses are not separately metered, an allowance of 82 ccf (100 cubic feet) per year will be deducted from the water consumption for each multiple family unit in the building and the remaining water consumption shall be billed at the appropriate commercial classification. The 82 ccf figure was derived from the 1998 sewer rate cost of service study performed by Integrated Utilities Group. Section 4. Review of User Fees. The City will review the user charge system annually and will revise the system as necessary to assure equity of the system and to assure that sufficient funds will be collected from the system to operate and maintain wastewater treatment services adequately. Section 5. Notification of Charges. The users will be notified at least annually, in conjunction with receiving the regular sewer bill, of the rate and that portion of the user charges which are attributed to wastewater treatment services. Section 6. Meters Required where Rate to be Determined by Water Use Volume. Water use volume shall be determined by the records of the water utility which serve the property. For all users for whom water consumption is used to determine the sewer use fee and who have a known or estimated volume of 1,000 or more hundred cubic feet per year, water consumption shall be determined by a meter installed in a manner approved by the City. Access to meters shall be granted to the City. In any case where a meter is required to determine the proper charges and the user refuses to Install a meter at his own expense or, if the volume is less than 1,000 hundred cubic feet per year, the City will estimate the charge to be made. This estimate will be made by a comparison of a similar user of similar size. ---PAGE BREAK--- Section 7. Special Requirements for 600 User Classifications. A portion of the use charge for classification 600 uses will be based on analysis of the user's sewage characteristics. Composite samples shall be taken by the property owner in a frequency and manner approved by the City. All necessary sampling manholes, access facilities and composite samplers shall be furnished and installed by property owners and shall be of a type and installed in a manner approved by the City. Access to sampling locations shall be granted to the City at all times. Analysis of the sample shall be done by the City or a certified lab and the cost shall be borne by the user. The fee for City analysis shall be per sample. Section 8. Quarterly Billing- Option. Any customer in the 200, 300, 400, 500, and 600 rate classes, or any residential account customer whose annual bill exceeds $1,000.00, which requests in writing and signed by the property owner, to be billed on a quarterly basis shall be entitled to be billed on a quarterly basis. The written request shall need to be received by the City of Missoula at least two months prior to the next regular semi-annual billing date of either January 1 or July 1. Water consumption records shall continue to be updated on an annual basis as is the current practice and the bill shall be divided into four equal bills rather than the current two semi-annual bills with the exception that the fixed charge per billing will be included on each of the two additional bills to be invoiced. The billing dates for the quarterly billing shall be January 1, April 1, July 1, and October 1 of each calendar year. Section 9. Sewer Use Fee Appeals Committee. There is hereby created a Sewer Use Fee Appeals Committee composed of the Wastewater Superintendent, Public Works Director and Finance Director or their designee. This committee shall review exceptions made under Sections 1, 2, and 3. The committee shall adopt rules for reviewing and approving requests for exceptions and such rules shall be approved by the Council. PASSED and adopted this day of , 2009. ATTEST: APPROVED: Martha L.
