City of Missoula, Montana Item to be Referred to City Council Committee Committee: Public Works Committee Item: Contract for Janitor Services for City Hall and Council Chambers Buildings Date: Wednesday, May 20, 2009 Prepared by: Jack Stucky Initiated by: Jack Stucky Action Required: Approve and authorize the Mayor to sign the contract with Opportunity Resources Inc. of Missoula, Montana to provide Janitorial services to City Hall at 435 Ryman Street and the Council Chambers building at 140 West Pine Street. Recommended Motion: The committee recommends the City Council approve and authorize the Mayor to sign a contract with Opportunity Resources Inc. of Missoula, Montana to provide Janitorial services to City Hall at 435 Ryman Street and the Council Chambers building at 140 West Pine Street. Timeline: Referral to committee: 6/1/09 Committee discussion: 6/3/09 Background and Alternatives Explored: Opportunity Resources Inc (ORI) is just that, an opportunity for people to apply the ability portion of their disabilities. This program is a win-win situation for the City of Missoula. The City receives janitorial services and at the same time provides employment, training, and livelihood to a group of folks who work hard to be productive in spite of physical and mental challenges. Opportunity Resources Inc. meets the criterion described below. Title 18, chapter 5 MCA is entitled “SPECIAL PURCHASING CONDITIONS”. PART 1 of title 18, chapter 5 is entitled “sheltered Workshops”. Subsection 18-5-101(1) MCA sets forth a statutory definition for “Certified sheltered workshop” or “work activity center” meaning nonprofit corporations for the purpose of providing vocational services to persons with disabilities that hold an appropriate certificate from the united States Department of Labor. Section 18-5-103 MCA pertaining to procurement requirements pertaining to purchasing either “listed products and services” from a sheltered workshop or work activity center provides that “THE PROVISIONS OF THIS TITLE RELATING TO COMPETITIVE BIDDING DO NOT APPLY TO PURCHASES MADE IN ACCORDANCE WITH THIS PART.” (Emphasis added). Financial Implications: This service contract has an average annual increase of approximately 3 percent higher than our existing contract rate with ORI. Attachments: Contract
