City of Missoula Public Works 435 Ryman Missoula, Montana 59802 RE: Miller Creek Road Improvements Briggs to Mockingbird Contract Amendment No. 3 Dear Steve: As a result of unanticipated circumstances and changes in the scope of the project, we are requesting that the following additional services be added to our existing contract for the Miller Creek Road Improvements Project. All of the work associated with these activities is beyond the scope of the current contract. Additional Services The vacation process for the 1896 petitioned road right-of-way resulted in additional coordination, design, and exhibits, beyond what was anticipated in the previous contract amendment. Amendment 2 provided for additional r/w exhibits and coordination, preparation of vacation exhibits, and additional project coordination and landowner meetings, totaling 312 hours, or $28,951. Between 9/1/08 and 6/8/09, approximately 617 hours, or $33,214, has been expended on these efforts. Missoula County has agreed to pay a portion of this cost related to the right-of-way staking performed for the Commissioners viewing, totaling $3001.75. Based on the direction of the County Commissioners and City Council, additional landowner meetings, agreements, exhibits, and design will be required to compete the vacation process. The following additional services would be added to our current scope: Prepare Slope Easement Agreements and Exhibits – Prepare slope easement agreements and legal recording exhibits for 15 parcels. Landowner Meetings – Meet with parcels 10, 11, 12, 13, 14, 15, and 19 regarding slope easements. Assume 2 meetings per parcel. ---PAGE BREAK--- Steve King June 29, 2009 Page 2 of 2 Revise Vacation Exhibits – Revise exhibits and legal descriptions for city and county parcels (19 parcels) describing the final negotiated right-of-way area to be vacated. Revise Sidewalk, Slope, and Driveway Design – Revise design plans, typical sections, cross sections, and driveway grading details. Update construction limits, quantities, and special provisions. Additional Project Coordination – Provide additional project management and coordination with the City and County staff, City Council, and County Commissioners. Fee Estimate The cost to provide these services is $46,340. The current contract amount of $364,865 would be revised to $411,205. A detailed cost estimate is attached.
