MILLER CREEK ROAD IMPROVEMENTS 05-033 INVITATION TO BID 00100-1 SECTION 00100 INVITATION TO BID RECEIPT OF BIDS: Sealed bids will be received by the City of Missoula at the office of the City Clerk, 435 Ryman, Missoula, Montana, 59802, until 1:00 p.m. local time on Monday, February 8, 2010, for the construction of the “Miller Creek Road Improvements - Briggs Street to Mockingbird Way” Project, and will then be opened and publicly read in the Mayor’s conference room. DESCRIPTION OF WORK: The project consists of reconstructing and widening approximately 3,400 feet of Miller Creek Road from Briggs Street to Mockingbird Way, including approximately 500 feet of Lower Miller Creek Road. The project includes realignment and reconstruction of the roadway to include demolition, excavation, curb and gutter, sidewalk, retaining walls, bike lanes, raised medians, new asphalt surfacing, chip and seal, storm drain, dry lay sanitary sewer force mains, connection of sewer services to existing STEP main sewer, utility relocations, lighting, installation of intersection control (roundabout) at the intersection of Upper and Lower Miller Creek Road, signing, striping, and associated work. PROJECT FINANCING – The Project is funded by the City of Missoula, and all applicable regulations for the City of Missoula and Montana Public Works projects shall be applicable, as indicated within the specifications. SITE OF WORK: The Project is located on Miller Creek Road, from the intersection of Briggs Street to Mockingbird Way, and approximately 500’ of Lower Miller Creek Road from the Upper Miller Creek and Lower Miller Creek wye intersection, in Missoula, Montana. COMPLETION OF WORK: All work must be substantially completed within 180 calendar days after the commencement date stated in the Notice to Proceed. OPENING OF BIDS: Bids will be publicly opened and read aloud at the time and place stated above. OBTAINING CONTRACT DOCUMENTS: The contract documents consisting of Drawings and a Project Manual may be examined or obtained at the following location: WGM Group, Inc. 1111 E. Broadway Missoula, MT 59802 (406) 728-4611 Copies of half-size set of Drawings and Contract Manual may be obtained upon paying a non-refundable fee of $50.00. Full-size drawings are not available for bidding. An additional charge of $10.00 will be applied for shipping and handling, if required. BID SECURITY: Each Bid shall be accompanied by Bid Security made payable to OWNER in an amount of ten percent (10%) of the Bidder’s maximum Bid price and in the form of cash, a cashier’s check, certified check, or bank money order drawn and issued by a national banking association located in Montana or by any banking corporation incorporated under the laws of Montana; or a Bid Bond (on form attached if a form is prescribed) issued by a surety authorized to do business in Montana meeting the requirements of Paragraph 5.01 of the General Conditions. The bid security shall identify the same firm as is noted on the bid proposal forms. The bid bond shall act as a guarantee that the bidder, if his bid is accepted, will execute the Contract, secure payment of worker's compensation insurance, and furnish a satisfactory faithful performance bond in the amount of 100 percent of the contract price and a payment bond in the amount of 100 percent of the contract price. CONTRACTOR’S REGISTRATION: CONTRACTOR’s and any of the CONTRACTOR’s subcontractors bidding or doing work on this project will be required to be registered with the Montana Department of Labor and Industry (DLI). No Bid shall be considered that does not carry the bidder’s Montana Contractor’s Registration Number on the Bid Form. Forms for registration are available from the Department of Labor and Industry, P.O. All laborers and mechanics employed by CONTRACTOR or subcontractors in performance of the construction work shall be paid wages at rates as may be required by Federal Law. The CONTRACTOR must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of 60 calendar days from the date of bid opening. Proposals must be sealed and marked "Miller Creek Road Improvements – Briggs Street to Mockingbird Way, opening February 8, 2010," and marked “Sealed Bid” with the CONTRACTOR's name, address, Montana Contractors Registration Number, and be addressed to: City of Missoula, City Clerk 435 Ryman Street Missoula, MT 59802 No facsimile bids will be accepted. WAGE RATES: The CONTRACTOR shall not pay less than the latest Montana Labor Standard Provisions minimum wage as determined by the U.S. Secretary of Labor. A copy of said wage rate is attached as part of the specifications in Section 00910. Bidder is subject to 18-2-401, et. Seq., Montana Code Annotated and amendments thereto and regulations issued there under, relating to prevailing wages, benefits, and other requirements. No claim for additional compensation will be allowed based upon a lack of knowledge or a misunderstanding of any such requirements by Bidder or failure to include in bid adequate increases in such wages over the term of the Contract. PRE-BID CONFERENCE: Prospective bidders are encouraged to attend a pre-bid conference, which will be conducted jointly by the OWNER and ENGINEER at the WGM Group, Inc., 1111 E. Broadway, Missoula, MT 59802 at 10:00 a.m. on Thursday, January 28th, 2010. PROJECT ADMINISTRATION: All questions relative to this project prior to the opening of bids shall be directed to the ENGINEER. It shall be understood, however, that no specification interpretation will be made by telephone, nor will any "or equal" products be considered for approval prior to award of contract. OWNER'S RIGHTS RESERVED: The OWNER reserves the right to reject any or all bids, to waive any informality in a bid, or to accept the lowest responsive and responsible bid and bidder, and to make awards in the interest of the OWNER. The low bid shall be determined on the basis of the lowest Basic Bid, or lowest combination of Basic Bid and accepted Alternative Bids if alternatives are included. The OWNER may accept in any order; any, all, or none of the Alternative Bids. AWARD CONTINGENT: Without limiting the foregoing, it is expressly stated that final award of the Contract is contingent upon securing appropriate financing.
