MULLAN ROAD GEORGE ELMER SIREN'S I RANCH PLANNED UNIT DEVELOPMENT (PUD) OVERLAY I. INTENT This site is located approximately 0.5 miles north of Mullan Road on the east side of George Elmer Drive. It is the intent of this PUD Overlay to modify the development standards of the base RM1-45 (Residential 1 – multi dwelling) zoning district in order to allow construction of dwelling units as provided below and shown in the attached exhibits. II. APPLICABILITY This PUD Overlay applies to Lots 2A – 41 of Ranch Subdivision, as shown in the attached Exhibit 1. This PUD Overlay does not apply to Lot 1 of Ranch Subdivision. III. GENERAL STANDARDS All applicable portions of the Zoning Ordinance of the City of Missoula, Montana (Missoula Municipal Code, Title 20) apply, unless otherwise expressly provided in this PUD Overlay. IV. PERMITTED USES Uses listed in accordance with the RM1-45 (Residential 1 – multi dwelling) zoning district. V. DEVELOPMENT STANDARDS ---PAGE BREAK--- A. General Standards 1. Glazing a. A minimum of 10% glazing is required on each side-loaded garage wall facing the street. B. Townhouse Standards 1. General a. For the purposes of this PUD Overlay, a townhouse is defined as “a residential building containing two dwelling units, each located on its own parcel with a common or abutting wall along a shared parcel line.” b. The Townhouse standards of this PUD Overlay apply to Lots 2A – 15B of Ranch Subdivision, as shown in attached Exhibit 1. c. Chapter 20.40.140 (Use- and Building-Specific Standards for Townhouses) shall not apply to this PUD Overlay. 2. Permitted Units a. Exhibit #2 illustrates the unit models permitted in this development. The unit models may be attached in any combination to form 2-unit townhouses. Each unit model shall substantially conform to the character of the corresponding elevation for the unit model, as shown in Exhibit and shall comply with the setbacks set out below. 3. Setbacks a. Minimum front yard setback: 10’, with the following exceptions: 1. Minimum front yard setback for front-loading garage: 20’ 2. Minimum front yard setback for side-loading garage: 10’ b. Minimum side yard setback: 1. On sides with a common or abutting wall: 0’ 2. On interior sides without a common or abutting wall: 5’ 3. On street sides: 10’ c. Minimum rear yard setback: 10’ or 1/2 building height, whichever is greater C. Detached House (Single-Dwelling Residence) Standards 1. Applicability a. The Detached House (Single-Dwelling Residence) standards of this PUD Overlay apply to Lots 16-41 of Ranch Subdivision, as shown in the attached Exhibit 1. 2. Setbacks a. Minimum side yard setbacks shall be as required for the RM1-45 (Residential 1 – multi dwelling) zoning district by the Zoning Ordinance of the City of Missoula, Montana (Missoula Municipal Code, Title 20). b. Minimum front yard setback: 10’, with the following exceptions: 1. Minimum front yard setback for front-loading garage: 20’ 2. Minimum front yard setback for side-loading garage: 15’ c. Minimum rear yard setback: 10’ or 1/2 building height, whichever is greater BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MISSOULA: ---PAGE BREAK--- THAT the above described property is hereby zoned with the classification of RM1-45 (Residential 1 – multi dwelling) with the Ranch PUD Overlay, subject to the stipulations set forth in this ordinance. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase and words thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or words have been declared invalid or unconstitutional, and if for any reason this ordinance should be declared invalid or unconstitutional, then the remaining ordinance provisions will be in full force and effect.
