The ke'L pads will require encroachments as shown on Exhibit The key pads will be placed in line with the existing tree planters so that the pedestrian route along Pine Street is not impacted. City of Missoula 435 Ryman Missoula, MT 59802 RE: GLR Properties I, LLC Parking Lot - Right of Way Encroachment for Parking Lot Gate Control Keypads Dear Kevin: Attached is an encroachment application and supporting documentation for two parking gate control keypads to be located on the south side of Spruce Street, north of the Garlington, Lohn, and Robinson (GLR) Parking Lot. The parking lot is owned by GLR Properties I, LLC and used by GLR's attorneys and staff. The keypads and gates are proposed to provide access control for the above-mentioned parking lot. Access control to the parking lot is currently achieved by signage at each entrance from Spruce Street. The signage has proven to be ineffective in preventing unauthorized users from entering and occupying parking spaces. As Garlington, Lohn, and Robinson's practice continues to grow (especially with the construction of the new office building on the corner of Broadway and Ryman), it is becoming more and more critical that each of their parking spaces be protected for use by authorized users only. Access to the parking lot will be controlled during operating hours, 6AM to 6PM, on weekdays for use by authorized users only. Conditional public use of the lot will be allowed off hours, on weekends and holidays by raising the gates during these periods. Public access and use of the parking lot is subject to the conditions described below. GLR Properties I, LLC, its successors and assigns, may after giving the City of Missoula reasonable notice of not less than 90 days, revoke the accommodation of public access and use of the parking lot. The accommodation for public access and use of the parking lot after hours, on holidays and weekends may not be revoked during the first twenty-four month period following the issuance of the above referenced encroachment permit, with the following exception: In the event that public access and use of the parking lot results in chronic or unusual vandalism, damage or inappropriate use, GLR Properties I, LLC, its successors and assigns may revoke the accommodation for public use and 3021 PALMER STREET P.o. The easterly 15 feet of the parking lot is currently owned by the City of Missoula. This 15 foot wide portion was used in the past for bus access to the old bus depot on Broadway. This portion has been used for parking by GLR for at least the last twenty years. The use of this 15 foot wide portion for diagonal parking requires access over the GLR Properties I, LLC's parking lot, so has limited value without such access. It is proposed that in exchange for the accommodation of public access and use of the parking lot, the City of Missoula allow continued use of this 15 foot wide portion for use by Garlington, Lohn, and Robinson subject to the following condition: Upon revocation of the accommodation for public access and use of the parking lot by GLR Properties I, LLC, its successors or assigns, the City of Missoula may restrict access to the easterly 15 feet of the parking lot area. As is shown on the attached parking lot layout exhibit, the configuration of the parking lot will remain in its existing condition, with the exception of the access gates and keypads.
