MISSOULA OFFICE OF PLANNING & GRANTS 435 Ryman MISSOULA MT 59802-4292 PHONE: (406) 258-4657 MISSOULA COUNTY MEMORANDUM DATE: April 30, 2010 TO: Mike Barton, Sr. Planner FROM: Tom Zavitz RE: Update on Application of Title 20 In the course of compiling items in Title 20 that need to be clarified, I received several comments on how the OPG permits and project staff were getting along using the new ordinance since its adoption on November 4, 2009. I think this is a good time to pass those on as an update. Overall, the reaction is very good from the staff. Generally, the biggest positive seems to be the better organization and clarity – less interpretation needed and more answers in print. The document simply reads with less ambiguity. The tables, Terminology section, and Use Classification sections seem to be the most helpful/most improved. One of the most recently hired staff said that it took a lot less time to learn how to use Title 20 than it did with Title 19. There were a couple of suggestions having to do with content and they may be taken up in the future. Three new ordinance regulations that attracted attention during the adoption process (accessory dwelling units, the number of new conditional use categories, and the administrative adjustment process) so far have gotten only a small amount of use. There has been one application for accessory dwelling unit which is still in the review process. There have been two applications for new conditional uses, also still in review and there have been two requests for administrative adjustments. Both of the administrative adjustment requests used incentives to reduce parking by 15% because the locations were near transit stop locations.
