Page 1 of 2 City of Missoula, Montana Item to be Referred to City Council Committee Committee: Plat, Annexation and Zoning Committee Item: Petitions No. 7660, 9470 and 9498 – Requests to Annex City Open Space and University of Montana Properties Date: October 20, 2010 Prepared by: Carla Krause, Special Services Administrator Initiated by: Carla Krause, Special Services Administrator Action Required: Adopt a resolution of intention to annex City and UM properties located in the southeastern quadrant of the City and schedule a public hearing in accordance with Montana Code Annotated Part 44 government lands method of annexation. Recommended Motion: I move the City Council…”adopt a resolution of intention to annex certain parcels and tracts of land consisting of portions of City open space and University property located in the southeast quadrant of the City; incorporate the area into the City of Missoula boundary and zone the property OP-1 Open Space, OP-2 Open and Resource Lands and OP-3 Public and Institutional Lands; and schedule a public hearing for December 6, 2010.” Timeline: Committee discussion: October 27, 2010 Adopt resolution of intention: November 1, 2010 Public hearing: December 6, 2010 Annexation becomes effective: January 6, 2010 Background and Alternatives Explored: 1. City and UM parcels consist of the City’s Mount Sentinel Open Space Lands and the portion of UM land with the Field House and M trail as well as a smaller parcel owned by the University that is contiguous. 2. Parcels are currently zoned in the County and the recommended City zoning upon annexation is: a. Parcel 1 is currently unzoned with a recommendation to zone as OP-1 Open Space in the city in accordance with 20.85.050(l)(2)(c); b. Parcels 2 and 3 are currently zoned C-A1 Open and Resource with a recommendation to zone as OP-2 Open and Resource in the city in accordance with 20.85.050(l)(2)(a) and ---PAGE BREAK--- Page 2 of 2 c. Parcel 4 is currently zoned as C-RR1 Low Density Residential with a recommendation to zone as OP-1 Open Space in the city in accordance with 20.85.050(l)(2)(c); and d. Parcels 5, 6, 7 and 8 are currently zoned as C-P1 Public Lands and Institutions with a recommendation to zone to OP-3 Public Lands and Institutional in the city in accordance with 20.85.050(l)(2)(a). 3. Assignments to City Council Ward areas would be: a. Parcels 2, 3 and 4 would become part of Ward No. 1; b. Parcels 5, 6, 7, 8 and the portion of Parcel No. 1 adjacent to and abutting Ward No. 3 would become part of Ward 3; c. Remaining portion of Parcel No. 1 adjacent to and abutting Ward No. 4 would become part of Ward 4. 4. Assignments to Neighborhood Council Districts would be: a. Parcels No. 2 and 3 would become part of the Lower Rattlesnake Neighborhood Council District; b. Parcels No. 4, 5, 6, 7, 8 and the portion of Parcel No. 1 adjacent to and abutting the District would become part of the University Neighborhood Council District; and c. Portion of Parcel No. 1 adjacent to and abutting the District would become part of the Farviews / Pattee Canyon Neighborhood Council District. 5. Government method of annexation requires the following steps be taken: a. “Holders of Interest” must petition for annexation. Owners completed this step with Petitions No. 7660, 9470 and 9498. b. City adopts a resolution of intention to annex and schedules a public hearing. c. Post legal notices in the newspaper. d. Observe a 20-day public comment period. e. Conduct the public hearing and if approved, adopt a resolution annexing. f. 30-days after approval, the annexation becomes effective. g. Within 30 days after approval the City Clerk must file a certified copy of the resolution at the County Clerk and Recorder’s Office. Financial Implications: No change is anticipated.
