RESOLUTION NUMBER 7544 A RESOLUTION TO ADOPT AMENDMENTS TO THE CITY OF MISSOULA SUBDIVISION REGULATIONS, ARTICLES 1 THROUGH 9. WHEREAS, 76-3-501 Montana Code Annotated authorizes the City Council to adopt subdivision regulations; and, WHEREAS, the City Council has adopted subdivision regulations for the City of Missoula with amendments; and, WHEREAS, 76-3-501 M.C.A. provides for the revision of subdivision regulations; and, WHEREAS, the proposed amendments to the City of Missoula Subdivision Regulations specifically revise Articles 1 through 9, in response to State legislative actions, alignment with recently established Title 20, agency comments; and to reflect County revisions; and WHEREAS, after public notice in the Missoulian, a newspaper of general circulation, on March 21st and 28th, the Missoula Consolidated Planning Board held two public hearings on April 6 and 20, 2010, to hear and consider recommendations; and WHEREAS, the Missoula Consolidated Planning Board unanimously recommended the approval of the Planning Board Draft 3/10/2010, with revisions, to the Missoula City Council; and WHEREAS, the City Council adopted Resolution #7526 on May 10, 2010, to declare it intention to consider adoption of the proposed revisions to Articles 1 through 9 of the City Subdivision Regulations, and set a public hearing for Monday, June 7, 2010. WHEREAS, the Plat Annexation and Zoning committee held a meeting on June 2, 2010 to receive background on the project; and WHEREAS, after public notice in the Missoulian, a newspaper of general circulation, on May 23, and May 30, 2010, the City Council conducted a public hearing on June 7, 2010 on the proposed revisions to the subdivision regulations in order to give the public an opportunity to be heard as required by 76-3-503 M.C.A; and WHEREAS, the Plat Annexation and Zoning committee held a meeting on June 16 and June 23, 2010 to consider amendments to the project. NOW THEREFORE, BE IT RESOLVED that the Missoula City Council adopts the revisions to Articles 1 through 9 of the City of Missoula Subdivision Regulations, as amended by the Missoula Consolidated Planning Board, and as amended by City Council.
