Draft 6/17/09 RESOLUTION NUMBER A RESOLUTION OF THE MISSOULA CITY COUNCIL ESTABLISHING A SPECIAL SCHOOL ZONE SPEED LIMIT OF 35 MILES PER HOUR, LOWERING TO 30 MILES PER HOUR BETWEEN THE HOURS OF 7:00 AM AND 5:00 PM ON DAYS WHEN SCHOOL IS IN SESSION, ON THE PORTION OF RESERVE STREET WHICH IS ADJACENT TO AND WITHIN 400 FEET OF THE PROPERTY BOUNDARY OF CS PORTER MIDDLE SCHOOL. WHEREAS, the Mayor requested the speed zone investigation be completed by the Montana Department of Transportation (MDT) near CS Porter Middle School; and WHEREAS, MDT completed a traffic study in the spring of 2009 in accordance with State regulations; and WHEREAS, the MDT speed zone review has concluded that 85th percentile speed ranged from 41 to 43 miles per hour; and WHEREAS, Montana Code Annotated (MCA) § 61-8-310(1)(d) authorizes local government authorities to decrease the speed limit near a school to “not less than 80%, rounded down to the nearest whole number evenly divisible by 5, of the limit that would be set on the basis of an engineering and traffic investigation”; and WHEREAS, MCA § 61-8-310(1)(d) authorizes local government authorities to adopt variable limits to adapt to traffic conditions by time of day, if warranted by a speed study; and WHEREAS, the traffic study conducted by MDT concluded that a variable speed limit could be accommodated, with signs and beacons purchased at no cost to the City, NOW, THEREFORE BE IT RESOLVED the Missoula City Council establishes a special school zone speed limit of 35 miles per hour, lowering to 30 miles per hour between the hours of 7:00 am and 5:00 pm on days when school is in session, on the portion of Reserve Street which is adjacent to and within 400 feet of the property boundary of CS Porter Middle School.
