The Minden Town Board meeting was held starting at 5:30 p.m. on Wednesday, July 11, 2018, at 1602 Esmeralda Ave, Minden, Nevada. Board Members present: John Stephans, Matt Bernard, Bill Souligny, Roxanne Stangle and Glen Radtke. Staff present: Jim Cavilia, JD Frisby, and Rachel Hamer. Chairman Bernard called the meeting to order at 5:30 p.m. The Pledge of Allegiance was led by Glen Radtke. PUBLIC COMMENT: One member of the public asked why the siren has not been working. Another member of the public expressed concern about the direction of the country and environment and recommended several books that cover a variety of topics of concern. APPROVAL OF AGENDA: Radtke/Stangle moved to approve the July 11, 2018 agenda. Motion carries unanimously. APPROVAL OF MINUTES: Radtke/Stangle moved to approve the June 13, 2018 Board meeting minutes. Motion carried unanimously. ACKNOWLEDGEMENT OF GIFTS: Mr. Frisby relayed a thank you to Model Dairy and Carson Valley Inn for their generous donations to the July 4th Celebration. The Board thanked everyone involved with these events and encouraged all the public who hasn’t attended to come next year. BOARD MEMBER REPORTS: Mr. Bernard gave an update on the possible acquisition of the Seaman Pond and is looking to go before the County Commissioners in September. Mr. Souligny gave an update on the Carson Valley Arts Council and the addition of another concert this fall. He also gave an update on the League of Cities and what they do for the Town. CONSENT AGENDA: 1. Approval of the June 2018 financial report including claims paid June 1, 2018 through June 28, 2018 for Fiscal Year 2018 and 2019. Stangle/Stephans moved to approve the Consent Agenda item. Motion carries unanimously. ADMINISTRATIVE AGENDA: 1. For possible action: Discussion and possible action to approve, approve with conditions, continue or deny a request by the Carson Valley Community Food Closet for the Town of Minden to sponsor and approve a 5k Fun Run/Walk, also known as the “Annual Carson Valley Turkey Trot.” Approval of this request would include approval of the route for the event and waiving the fees associated with the use of Minden Park, Town equipment and an intermittent street closure impacting multiple streets in the Town of Minden between Spruce Street and Burrukia Street and US Highway 395 and Wildrose Drive and Labarantcha Road for small periods of time between the hours of 7:00 am and 11:30 am on November 22nd, 2018. Where possible, impact to residential homes on the route will be mitigated by encouraging participants to utilize sidewalks. Volunteers will be posted at intersections to assist participants with safe ---PAGE BREAK--- Minden Town Board Minutes July 11, 2018 Page 2 of 4 crossings along the route. Traffic control and safety plans for the event will be reviewed and approved by the Douglas County Sheriff’s Office and Town of Minden Staff. It is anticipated that no street or intersection will be closed for longer than 5 minutes at a time. Appearance Connie Billington, Jacie Peters and Denise Banes on behalf of the Carson Valley Community Food Closet. Connie Billington and Jacie Peters thanked the group that came to the meeting for showing their support and relayed that at their first Turkey Trot Event last year they were able to redistribute $9000 to D.A.W.G. and the Carson Valley Community Food Closet. They addressed the later start to accommodate the noise problem, and relayed the change to the route to make it a true 5K. Board comments included support of the event and concern over the level of sound. Public comment: A member of the public expressed concern over insurance. For possible action: Discussion and possible action to approve, approve with conditions, continue or deny a petition for annexation by Park Ranch Holdings for the Klauber Ranch Property at APN’s 1319-25-000-020 and 1319-25-000-021. Appearance Keith Ruben, Director of Planning, RO Anderson Engineering. Mr. Bernard recused himself from Administrative Agenda numbers 1 & 2 as he works in a capacity for R.O. Anderson. Mr. Stephans expressed concern over the discrepancy on the application versus the agenda as it is written. Town Counsel said, because the agenda and backup material were correct they could move forward if the Board wished. Public Comment: None After thoughtful and intelligent deliberation Mr. Stephans moved to pull the item from the Agenda with Mr. Souligny seconding the motion. The Board voted 2-2 with Stephans and Souligny voting yes, Stangle and Radtke voting no, Bernard abstaining. Motion does not carry. At the request of the applicant, no further action was taken. 3. For possible action: Discussion and possible action to recommend to Douglas County Staff approval, approval with conditions, continuance or denial of LDA 18-008, a Commercial Subdivision tentative map. This application has been submitted by And Away They Go, LLC; the subject property is located at the intersection of U.S. Hwy 395 and State Hwy 88 in Minden NV, which include portions of APN’s 1320-30-601-009, 1320-30-702-024, and 1320-30-702-029. Appearance Keith Ruben, Director of Planning, RO Anderson Engineering. Mr. Ruben gave a presentation regarding the proposed commercial subdivision tentative map. He clarified that what they are bringing forward better matches what the Board saw as the conceptual mapping as opposed to the way the parcels were zoned and mapped for the Master Plan changes in 2016. Public comment: None After thoughtful and intelligent deliberation Stephans/Souligny moved and seconded approval of LDA 18-008, a Commercial Subdivision tentative map; the subject property is located at the intersection of U.S. Hwy 395 and State Hwy 88 in Minden NV, which include portions of APN’s 1320-30-601-009, 1320-30-702-024, and 1320-30-702-029. The approval is conditional on following the staff recommendations. Motion carries 4-0 with Bernard abstaining. 4. For possible action: Discussion and possible action to recommend to Douglas County approval, approval with conditions, continue or denial of the proposed ordinance changes to Tile 20 as related to Vacation Home Rentals. If the Board recommends approval of the ordinance change, the Board may also recommend participating in the permitting process. Appearance by Mimi Moss, Director of Douglas County Community Development. Ms. Moss gave the background to the ordinance for Vacation Home Rentals and why this item has come forward. The Planning Commission heard this item yesterday and unanimously voted to keep Vacation Home Rentals only in Tahoe Township, require proof of liability insurance, add flexibility in the bear box requirement, better clarify the private party use section and add a penalty for repeat offenders of the code. The changes would also assist with monitoring the safety and parking situations for these properties. One of the changes would be a requirement to have a letter from the GID, Town or HOA as part of the initial permitting process. She gave an overview of permitting fees, fines, and violations and how that is managed. Board comments included agreement with the new changes but wishing that the County had more power of enforcing. Ms. Moss also mentioned that there is a thought out there to move forward with only the Tahoe Township with the proposed changes and see if it works well and then if successful, bring it back to the Towns for possible inclusion. Several Board members agreed with that possibility. Ms. Moss said that if the direction from the County Commission is to move forward to approve this for the entire County that she would recommend the Towns and GID’s be a part of this process regardless of what the Town Board votes. Another Board member expressed concern that this would be considered for Minden and felt that this does not fit with the Town. Public comment: Chairman Bernard mentioned that there was a letter submitted to the Town Board from Margaret Pross and was given to each Board Member for the record. A copy of that letter is attached to these minutes. Jan from the Carson Valley Visitors Authority said that they are in support of parity with Tahoe and in the Valley. They are in support of getting out in front as it is already happening. ---PAGE BREAK--- Minden Town Board Minutes July 11, 2018 Page 4 of 4 After thoughtful and intelligent deliberation Souligny/Stangle moved and seconded to recommend approval to the County Commission for the proposed ordinance change as presented for Vacation Home Rentals be endorsed by the Town Board and also in support of the additional ordinance changes recommended by the Planning Commission and that all changes apply only to the Tahoe Township. Motion carries unanimously. 5. For Possible Action: Discussion and possible action to direct Staff regarding possible relocation of the digital speed signs on Wildrose Drive to 10th Street in order to collect data regarding complaints of excessive speeding. Appearance by JD Frisby, Town Manager. Staff brought this item forward in regard to repeated complaints and got another quote in regard purchasing another set of signs. The thought was to try and collect data to determine what kind of problem if any is occurring on that street. Board comments included the desire to keep the signs over on Wildrose where they seem to be working. Other comments included the desire to move speed tables there, what would be the best process to move forward on this with the residents that it directly affects. Would it be possible to lease the signs or if we can look at a portable street sign that we might be able to use similar to the ones from the Sheriff’s Office. Public comment: None After thoughtful and intelligent deliberation Souligny/Radtke moved to direct staff to look into portable speed limit signs which record and display speed and other possible options and bring it back to the next available meeting. Motion carries unanimously. 6. For possible action: Discussion and possible action to direct staff in relation to Staff Reports. Discussion shall include a Staff Report on the activities, progress on or status of assigned tasks and projects, or general information regarding operations and projects related to trash, retail and wholesale water service, and other functions of the Town of Minden. Appearance by JD Frisby, Town Manager. Mr. Frisby gave an update to the Board on the splash pad and events and offered to answer any questions. Mr. Radtke asked about the Rotary monument. Mr. Souligny asked for some clarification on the Seaman Pond right of way issue, the time line for the recycling center opening, and questions on the finalization of the Lucerne Street. Public comment: None PUBLIC COMMENT: A member of the public gave the names and authors of each of the books he mentioned earlier in the meeting and mentioned the yellow stripe around the flag. He referenced several videos and books in regards to a multitude of items ranging from schools to the United Nations. ADJOURNMENT: Mr. Souligny moved to adjourn the meeting at 7:37pm.
