The Minden Town Board meeting was held starting at 5:30 p.m. on Wednesday, June 7, 2023, at 1602 Esmeralda Ave, Minden, Nevada. Board Members present: Susan Jackson, Bill Driscoll, Larry Walsh, Bryan Davis and Steven Thaler. Staff present: Ryan Russell, JD Frisby, Jeff Cady and Rachel Hamer. Chairman Thaler called the meeting to order at 5:30 p.m. The Pledge of Allegiance was led by Vice Chairman Davis. PUBLIC COMMENT: None APPROVAL OF AGENDA: Jackson/Driscoll moved and seconded approval of the June 7, 2023, Agenda as presented. Motion carries unanimously. APPROVAL OF MINUTES: Walsh/Davis moved and seconded approval of the May 3, 2023 Board Meeting Minutes. Motion carries unanimously. ACKNOWLEDGEMENT OF GIFTS: None at this time. BOARD MEMBER REPORTS: Member Driscoll gave an update on the Chamber and the Good Governance Group. Member Walsh brought up saving for large projects at Jakes and Seeman Pond. Member Jackson thanked Staff for prepping for the event this weekend. Vice Chairman Davis relayed excitement for moving into event season. Chairman Thaler thanked Staff for working this weekend. CONSENT AGENDA: 1. Approval of the May 2023 financial report including claims paid April 22, 2023 through May 26, 2023 for Fiscal Year 22/23. 2. Approval of the policy renewal from Nevada Public Agency Insurance Pool (POOL) and authorization of payment to POOL in the amount of eighty one thousand, three hundred and thirty nine dollars, and forty four cents ($81,339.44) for Fiscal Year 2023-2024. 3. Approval of an outdoor festival entertainment event application by Carson Valley Active 20-30 Club #85 for the 113th annual Carson Valley Days June 8th – 11th , 2023. This event includes closure of the following streets from 6:00 am to 12:00 pm, Saturday June 10th, 2023, for the Carson Valley Days parade: County Road from Hwy 88 to Sixth Street, Sixth Street from County Road to US HWY 395 and Esmeralda Avenue from Sixth Street to US HWY 395. Approval of this event also includes concurrent closure of Fifth Street from Esmeralda Avenue to Mono Avenue for the 11th annual Town of Minden Carson Valley Days Breakfast. ADMINISTRATIVE AGENDA: 1. For possible action: Presentation and discussion on an update to the 2003 Douglas County Trails Master Plan. Presentation by Derek Kirkland, Principal Planner at Wood Rogers and Brook Adie, Assistant Director of Douglas County Community Services. Mr. Scott Morgan introduced Derek Kirkland with Wood Rogers. Mr. Rogers gave a presentation on the update to the existing trails plan. He discussed what the steps are for public outreach and working in coordination with the various Boards and GID’s. Member Walsh asked what ways people could get from Minden to the Pinenuts. Mr. Morgan relayed there is not anything currently available. They expressed the desire to have this option but also to get to Genoa. Member Jackson asked about the trail system trash and how can we keep up maintenance. Mr. Morgan relayed that there is an education piece for the users regarding trash and etiquette. Chairman Thaler asked about lines on the river. Mr. Morgan said there are not any in this plan, and they are working with landowners and managers to make sure there are no surprises when the trails are lined out on maps. Mr. Frisby asked Mr. Morgan to look at the Park Land for future Minden planning. Public Comment: Debra Lang gave public comment on the priorities. She asked if Board Members could fill in the survey that is being sent out to the public. No formal action on this item. 2. For possible action: Action to approve, approve with conditions, or deny a will-serve request for municipal water service to the proposed Pine Nut Ranch Estates subdivision located at East Valley Road and Stockyard Road. This subdivision proposes 118 single family residential lots ranging from 2.0 acres to 7.6 acres. The proposed subdivision is outside of the Town’s water service area, but directly adjacent to the Minden Plan for Prosperity Planning Area, established for planning of long-term growth. Possible conditions of approval may include implementation of a special rate structure and/or requiring the developer to cover the cost of a special rate study to be performed by the Town’s Engineering Consultant, or other third-party consultant. Approval may also be conditioned on the developer purchasing water rights from the Town of Minden. This action item is being presented to the Town Board subsequent to the developer receiving a denial letter from Douglas County Public Works on a water service will-serve request. Denial from the Town Board on this request for municipal water service would effectively require the developer to form a new private water system in order to develop the property. Appearance by Lisa Nash, Planner, Christy Corp and Justin Sand, Senior Project Manager, Lumos Engineering. Lisa Nash with Christy Corp gave a presentation as to why this is back before the Board. Since Douglas County did not give a will-serve letter, this development is back before the Board to ask for consideration to provide water to the development. Member Jackson relayed that she did not feel that this development does not benefit the Town of Minden. ---PAGE BREAK--- Minden Town Board Minutes June 7, 2023 Page 3 of 3 She expressed concern with the sale of this many water rights. Member Walsh expressed concern with stretching out the service area that far. He did not agree with the assessment that this development would provide much needed housing. Vice Chairman asked what the arsenic levels were. It was relayed that there have been no tests on the parcels yet, but the surrounding areas have a higher arsenic level. Member Driscoll expressed that he could support a development that was part of the Town, but believes this is a County issue. Chairman Thaler thanked the applicant for coming back, but also believes this should be handled by the County. He expressed concern over groundwater out at this site. Public comment: Mr. Robert Pohlman gave public comment on the project and did not feel that the benefits did not necessarily benefit Minden but the County as a whole. He recommended this get tabled. Ms. Roxanne Stangle gave public comment on the need to keep the residents of Minden in mind. He asked if the Town would be open to annexation. Due to it not being adjacent to the Town this is not possible. Vice-Chairman Davis made a motion to continue the item. No second on the motion. After thoughtful and intelligent deliberation, Thaler/Walsh moved and seconded denial of the water will serve to the proposed Pine Nut Ranch Estates Subdivision located at East Valley Road and Stockyard Road. Motion carries unanimously. 3. For possible action: Discussion and possible action to direct Staff in relation to Staff Reports. Discussion shall include a Staff Report on the activities, progress on or status of assigned tasks and projects, or general information regarding operations and projects related to trash, retail and wholesale water service, and other functions of the Town of Minden. Appearance by Jeff Cady, Public Works Superintendent and JD Frisby, Town Manager. Mr. Cady offered to answer any questions the Board may have. Mr. Frisby gave an update on the Seeman Pond and offered to answer any questions they may have. Public comment: None ADJOURNMENT: Chairman Thaler adjourned the meeting at 6:44 p.m.
