The Minden Town Board meeting will be held on Wednesday, February 4, 2009 at 1602 Esmeralda Avenue in Minden, Nevada beginning at 6:00 p.m. NOTICE: NRS 237: The Minden Town Board has adopted a Standard Policy No. 7, which contains a motion regarding Business Impact Statements. When the Town Board approves its agenda, it also approves a motion which includes ratification of staff action taken pursuant to NRS 237.030 et seq. with respect to items on the Board’s agenda. This includes, without limitation, the conclusion that each rule, ordinance, or regulation which is on the Board’s agenda is without direct and significant economic burden on a business or direct restriction on the formation, operation, or expansion of a business; and that each rule, ordinance, or regulation which is on the Board’s agenda for which a BIS has not been prepared does not impose a direct and significant economic impact on a business or a direct restriction on the formation, operation, or expansion of a business. NOTICE to persons with disabilities: Reasonable efforts will be made to assist and accommodate physically handicapped persons desiring to attend the meeting. PRELIMINARY MATTERS AND PUBLIC INTEREST COMMENTS 6:00 p.m. Call meeting to order 1. Pledge of allegiance 2. Approval of agenda 3. Approval of minutes of January 7, 2009 4. Approval of vouchers 5. Public comment: Discussion may be limited to three minutes per person at the discretion of the Chair. No action may be taken on a matter raised under this portion of the agenda until the matter itself has been specifically included on an agenda as an item upon which action may be taken. STAFF REPORTS Note: Items on the Administrative Agenda will not be discussed during the staff reports. 1. Public Works: report of activities by Public Works Staff 2. Engineering Report: Discussion may include streets, sidewalks, drainage, water issues and related items. 3. Douglas County Community Development: Annual training on land-use planning and zoning by Harmon Zuckerman, Principal Planner. 4. Attorney Report: Discussion may include factual and legal aspects of the performance by the town and its advisory board of functions granted to the ---PAGE BREAK--- Minden Town Board Agenda February 4, 2009 Page 2 of 3 Town under the provision of Chapter 269 of the Nevada Revised Statutes, the Douglas County Code, the Town ordinances and policies. These items include, without limitation, streets, sidewalks, drainage, water rights, water distribution rates, and Chapter 237 of NRS. 5. Board member reports:  Chairman’s report  Board member comments Administrative agenda: The following item(s) are scheduled for public hearing. The Chairman will read the Agenda listing into the public record. The Board and its Chairman reserve the right to vary the format to fit the agenda item. The Chairman will read the Agenda item into the public record. Staff will present a summary of the staff report and recommendations, including any updated information received by the Board after the staff reports are distributed. The Board will follow with questions of staff. The Chairman will then open the hearing to public testimony. Normally, applicants or their representatives are permitted to speak first, followed by Board questions. The Chairman then invites public comment. The Chairman has the right to establish time limits for comments and to allow for rebuttal by the applicant. To ensure that all citizens desiring to speak before the Board have the opportunity to express their opinions, it is requested that the audience refrain from making comments, clapping or making any remarks or gestures that may interrupt or prevent the speaker from commenting on the matter before the Board. The Minden Town Board reserves the right to take items in a different order to accomplish the tasks before the Board in the most efficient manner. PUBLIC INTEREST COMMENTS (NO ACTION); ACTION ITEMS The “Public Interest Comments” portion of the meeting is open to the public to speak on any topic not on the agenda and is limited to 3 minutes. For any item on the agenda, public comment is discretionary, except where a public hearing is legally required. For members of the public not able to be present when an agendized item is heard, Comment Cards are available at the entrance to the meeting room. These cards should be completed and given to the Town secretary. NOTE: THE TOWN BOARD IS PROHIBITED BY LAW FROM TAKING IMMEDIATE ACTION ON OR DISCUSSING ISSUES RAISED BY THE PUBLIC THAT ARE NOT LISTED ON THIS AGENDA. UNLESS OTHERWISE NOTED, ALL ITEMS WILL INCLUDE DISCUSSION BY THE BOARD AND POSSIBLE ACTION BY THE BOARD TO APPROVE, MODIFY, DENY, OR CONTINUE THE NOTICED MATTER. ---PAGE BREAK--- Minden Town Board Agenda February 4, 2009 Page 3 of 3 7:00 p.m. Discussion and possible action: Presentation on utilizing construction management as an alternative delivery mechanism compared to the traditional design, bid, build (low bid) approach for municipal construction projects. Discussion will include the pros and cons of construction management from both the clients and construction managers' perspective. No action on this item is anticipated. 7:20 p.m. Discussion and possible action: Approve, approve with conditions, deny or continue request of approval for Farmers Market to take place on Esmeralda Street on Tuesdays from June through September 2009. 7:30 p.m. Discussion and possible action: Approve, approve with conditions, deny or continue request of approval for Design Review of duplex apartment and 9 foot setback on west and east property line for garage only at 1576 Mono Avenue APN 1320-32-111- 077, Don Park applicant. 7:35 p.m. Discussion and possible action: Approve, approve with conditions, deny or continue request to award recommended bid for the 2009 Alley and County Road Waterline Upgrades Project. The board will decide whether to enter into a contract with the lowest responsive bidder for the project. Bids will be opened on January 29th, 2009. 7:40 p.m. Discussion and possible: Approve, approve with conditions, deny or continue request of approval for re-equipping Well # 1 with a new pump and motor, VFD Drive, electrical service upgrade and pump house building. These are the estimated costs to complete this upgrade: Pump and 100 hp motor Carson Pump $31,400 Up grade electrical service SPPC $20,000 est. VFD Drive controller & Electrical Buffo $20,000 est. 10' x12' pump house Town of Minden $10,000 est. 7:45 p.m. Discussion and possible action: Continuing discussion on annual review of CVIC Hall, Minden Park, and Street Closure rates taking into consideration increase or decreases, as applicable, of materials costs, labor rates, insurance rates and other factors. The Board plans to take no formal action on this item other than possibly setting another hearing on this matter. A business impact statement will be prepared and made available to the public before this matter is acted upon by the board at a future agenda meeting.
