Many Millcreek residents call the City to complain about unkempt rental houses in their neighborhoods. Landlords who are inattentive or lackadaisical impose a significant burden on Millcreek's code enforcement resources. Oftentimes, when presented with a code violation, a landlord will resolve a problem temporarily, only to subsequently ignore it and let the tenants again violate the law. Repeated violations result in additional complaints from the neighbors and require additional code enforcement efforts. Until recently, Millcreek's ordinances did not provide sufficient tools to deal with these cycles of violations. While code inspectors could issue another notice of violation, the City has had no ability to shut down repeat offenders. Because the cost of code enforcement has been borne by the taxpayers, landlords have had no financial incentive to permanently resolve the problems their tenants create. The City Council recently determined that because the landlords earn an income from the rental of their properties, they should bear the cost of ensuring that tenants comply with the law. Thus, as of January 1, 2019, owners of one- and two-family dwellings in Millcreek who rent out their properties must obtain a business license and pay an annual $60 fee for each of their rental units. See Millcreek Ord. 18-53 and Ord. 18-64. (Many of our neighboring cities have adopted a similar licensing requirement, though they all charge much higher rates than Millcreek). Collection of the licensing fees will help the City pay for code enforcement efforts related to rentals. Additionally, should a landlord not take sufficient steps to permanently solve code compliance issues, the City will have the ability to revoke the business license and terminate the right to rent the property. An unlicensed landlord will be subject to being shut down by court order. As of January 1st, all of these enforcement tools will be available to the City. ---PAGE BREAK--- 3/27/2019 Landlords instead of taxpayers will soon bear cost of code enforcement against rental properties 3/7 We know that many of our landlords take care of their properties and do not contribute to the issues we are trying to address. Unfortunately, we cannot give a good landlord discount, because state law does not currently allow a rebate to owners of one- and two-family rental properties. To apply for a business license, property owners must submit a completed application, a One- and Two-Family Rental Affidavit, and pay $60 per rental unit to the City. Click here to obtain the forms. The southeast corner of 23rd East and 33rd South has been rather dreary ever since the Dan's closed last winter. That's about ready to end. Millcreek resident Rich Israelsen, who works with DownEast Home & Clothing, tells us that the company will be opening its new flagship store at this location. Rich says that the the store also will launch a new concept for the company by "put[ting] a special focus on celebrating the local community and entrepreneurship of all ages."
