January 2025 Millcreek Together Code Update I 18.12 – 18.15 Application Procedures Summary Sheet Chapters 18.12 – 18.15 Application Procedures A. Purpose. These chapters establish generally applicable land use provisions, establish land use authority designations, establish land use procedures in general, and establish procedures for each land use application type. B. What Changed. o This is entirely new language. o Our current code has limited application procedure information, and only in certain chapters, such as CCOZ, FCOZ, or conditional uses. o These chapters compile all this information in one place, along with noticing requirements and the role of community councils for ease of readership and accessibility. o Certain changes to the procedures for subdivision approvals were made to ensure compliance with state statute. o Planning Commission is to give a recommendation on municipal utility easement and public street vacations. C. What Remained the Same. o Land Use Authority Designations that are established in the current code remain the same for the proposed code. o Noticing requirements remain the same. o Applicants subject to community council recommendations remain the same. D. Rationale for Changes. o Currently, application procedures, roles of public bodies, and noticing requirements are found in different sections of Millcreek’s land use code, and the code currently lacks a single location for an applicant or staff to obtain information pertaining to an application. As the Millcreek Planning and Zoning Department seeks to refine and codify its procedures, staff recommends adoption of an ordinance that consolidates the information, so that an applicant can get a complete sense of the requirements by application type, without having to search several different chapters in the code. ds.
