January 2025 Millcreek Together Code Update I 18.60 Nonconformities Summary Sheet Chapter 18.60 Nonconformities Summary A. Purpose. The purpose of this chapter is to establish regulations governing legally established uses, structures, lots or parcels, and other circumstances that do not conform to applicable requirements of this title. The intent of this chapter is to control expansion of nonconforming conditions while recognizing the interests of affected property owners. B. What Changed. o State exemption requirements referencing when termination procedures for billboards. o A nonconforming determination status procedure section outlining criteria for legally existing nonconformities. o Separate section referencing nonconforming lots and parcels. o Updated language for parking requirements due to nonconforming expansions. C. What Remained the Same. o The substance of the nonconforming section will remain the same but with updated language primarily for clarification and aligning with state code, o Abandonment requirements for nonconforming structures including dwellings. o Application requirements to have a structure declared a noncomplying structure. D. Rationale for Changes. Over time, land use patterns and codes have evolved. Unfortunately, large areas of Millcreek have remained the same where existing legal nonconformities do not qualify for redevelopment because they cannot align with the long-term vision or goals. This often times results in community decay and hinder redevelopment or revitalization efforts in older areas. Updating our codes helps ensure that land use regulations support the current and future needs of the area and provide clearer guidelines or incentives for property owners to bring their properties into compliance, thus encouraging investment in underutilized or aging areas.
