Millcreek Public Works Department 3330 South 1300 East Millcreek, Utah 84106 Phone: (801) 214-2700 Inspections: (801) 688-8630 Version: March 9, 2021 - Page 1 of 3 Millcreek Sidewalk Curb and Gutter (C&G) 50/50 Cost-Sharing Program (Ordinance 14.12.027 New, Repair, Or Replacement Option and Costs) Purpose The Millcreek Sidewalk/C&G Cost-Sharing Program offers residents an immediate and economical way to repair or replace broken sidewalks, drive approaches and/or curb and gutter located in front of their property. Eligibility Sidewalks, Curb and Gutter installation, repair or replacement projects must be in a Millcreek residential neighborhood and within a Millcreek-owned right-of-way. To be eligible for reimbursement, the applicant must be a current Millcreek resident, reside in the home located on the property, and the property must not be subject to a delay agreement or a required improvement by the Millcreek Code of Ordinances or the Planning Commission. Funding Reimbursement will occur on a first–come–first-serve basis. Once the funding is exhausted, the 50/50 Program will not be available until future funding is secured. Standards All Sidewalk/C&G installation, repair, or replacement must comply with current Millcreek engineering standards, which are attached at the end of this application. Millcreek engineering standards include but are not limited to a requirement that the contractor delivers to Millcreek a payment bond and performance bond in an amount equal to 100% of the price specified in the bid. See Utah Code Ann. § 63G-6a- 1103. Obtaining Bids The applicant must obtain at least 2 bids and provide Millcreek with the bids for review. Bidders must be contractors that are licensed by the State of Utah. If Millcreek finds a bid acceptable, then Millcreek will notify applicant of approval (see application form below). Construction Prior to beginning work, the applicant or their contractor are required to obtain a Right-of-Way Improvement Permit from the Millcreek Building Department. Owner/Contractor is required to have city inspection before and again after placing the concrete. The contractor is required to provide Millcreek with a performance and payment bond. If the site plan and scope of work are approved, and funds are available, Millcreek will notify the applicant via the owner’s email provided above. Millcreek Approval Signature Date Approved Obtain Bids Obtain at least 2 bids and submit to Millcreek (Bids may vary greatly in cost from one contractor to another – Millcreek recommends obtaining 3-5 bids to gain the best value for the owner and the city). Unless approved otherwise by Millcreek, the low bid contractor will be used. If applicant obtains bids or permits prior to submitting the application, Millcreek will not participate in cost-sharing or issue a reimbursement upon completion of the project. The contractor is required to provide Millcreek with a performance and payment bond. A final inspection may be scheduled any time after placement. A reimbursement check will be issued payable to the applicant typically within two-weeks’ time.
