January 2025 Millcreek Together Code Update I 18.36 Forestry Recreation Estate (FRE) Zone Summary Sheet Chapter 18.36 Forestry Recreation Estate (FRE) Zone Summary A. Purpose. The purpose of the Forestry Recreation Estate (FRE) zone is to permit the development of the foothill areas of the City for forestry, trails, and residential uses to the extent such development can mitigate the potential natural hazards/sensitive lands, if any, on the lots in this zone. The foothill area of Millcreek was previously zoned as Forestry Recreation (FR) and allowed many uses that do not fit the current climate of the area. The FRE zone was adopted in February of 2024. B. What Changed. o Making the FRE Zone a legacy zone meaning no more properties can be added to this zone. o Increasing the minimum lot size to five acres to limit new development in the foothills area of Millcreek. o Removing detrimental and extraneous uses found in the FR zoning code such as mining, ski resorts, and golf courses to list a few. o Increased required setbacks for new developments. C. What Remained the Same. o Low intensity uses such single-family homes are still a permitted use. o Some regulations have remained such as maximum height of 35 feet for new buildings. D. Rationale for Changes. The previous FR zone was a county created zone that allowed for mining, heavy recreation, and logging uses. The areas with this zoning in Millcreek have steep slopes and are not suitable for these intensive uses. Changing the zoning to FRE with updated standards will preserve the foothill area from intensive uses that would diminish the natural beauty of the area and create potential environmental problems. The Millcreek General Plan has multiple goals laid out that aim to protect this area from development.
