Millcreek 3330 South 1300 East Millcreek, UT 84106 Request for Proposals Former Wilford Ward Property use due December 16, 2022, at 4:00 p.m. local time 1. Introduction. Millcreek (the “City”) is requesting proposals/bids (“Proposals” or “Responses”) from qualified proposers (“Proposers”) to purchase from the City and develop 1.0 acre of real property located at 3179 South Highland Drive, Millcreek, Utah (“Proposal”). 1.1. Intent. It is the intent of this Request for Proposals/Bids (this “Request”) to set forth the minimum acceptable requirements for Responses to this request. 2. Background and Detailed Description of Scope of Work. The City is a suburban/semi-urban municipality of approximately 65,000 residents. Among a wide spectrum of residential strata, the City has a moderate amount of active commercial enterprise, including small businesses, public and private schools, a major hospital, clinics, libraries, and community supporting non-profit headquarters. Fifty percent of households can be described as starter homeowner, young professional, and generationally established. The City has purchased and is in the process of demolishing, as required by seller, the former Wilford Ward meetinghouse of The Church of Jesus Christ of Latter-day Saints located at located at 3179 South Highland Drive, Millcreek, Utah. The City has utilized some of that property for utilities and some for road right-of-way and has surplused the remaining 1.0 acre. The City desires to recoup its expenses for this property and assure that a development will be complementary to the City Center, contribute in a significant way to the City’s economic viability, transition appropriately to the adjacent residential neighborhood, and complement the aesthetics and vitality of the Highland Drive corridor. 3. Proposal Requirements. Two written copies and an electronic copy in PDF (Portable Document Format) of the Proposal are required to be submitted to Moira Gray, Millcreek Economic Development Assistant, as listed below, no later than 4:00 p.m. local time on December 16, 2022. Any response, modification, or amendment received after the due date and time is considered late. No late response, modification, or amendment will be accepted. Except for the PDF copy refenced above no electronic Responses will be accepted. Proposals must include the following elements and be signed by an authorized representative of the Proposer: 3.1. Introductory Letter. An introductory letter expressing an interest in purchasing and devoping the site should be included. Proposed Property Use. Explain what the Proposer plans to develop on the property, including a site map of proposed uses of the property (with at least two color renderings) and elevations of the proposed project or similar projects. Describe the uses, building heights, and parking configurations. 3.3. Price. Proposer shall include what they are willing to pay for the one acre of property as is. Minimum bid is $1,991,529 (calculated as the $39.98 per square foot the property appraised for, plus the $250,000 the City has expended for the site’s environmental and demolition work.) 3.4. Qualifications and References. Introduce the proposing team and their qualifications. Describe, in detail the Proposer’s experience in developing similar projects. Include the name, address, and contact person of government or private agencies with which the Proposer has provided a similar service. The City may contact such references and do its own investigations and depending on the result of the investigation may result in disqualification based on the City sole and absolute discretion. 3.5. Timeline. Describe, in detail, the timeline for delivery of the Scope of Work. 4. Relevant Additional Information • Due to the abundance of rental market multifamily development entitled already in the City Center, the City is especially interested in proposals involving commercial, restaurant, retail, or office. • While existing height limits on the property are at 26’, reasonable exceedances of that height may be considered in context with the project (subject to final Planning Commission and City Council approval). ---PAGE BREAK--- Request for Proposals • While the current property is not all one zone, a city initiated zone change will take place once the winning Proposal has been selected to match the zone with the zoning needed for the selected Proposal. • All land needed for adjacent right of way dedications on Highland Drive and Woodland Avenue have already been removed. This is a true one acre ready for development! • City has completed a Phase One environmental assessment and performed all environmental mitigations required to demolish the meetinghouse. • City will complete the demolition of the former church meetinghouse by mid- December. • Location maps: ---PAGE BREAK--- Request for Proposals 5. Identification of Anticipated Potential Problems. Proposals should identify and describe any potential problems with respect to providing the Scope of Work. ---PAGE BREAK--- Request for Proposals Page 5 of 5 6. Evaluation Criteria and Scoring Process. All Proposals received will be reviewed by the Evaluation Committee. Each evaluation criterion has been given a percentage based on its relative value. The criteria and each associated percentage are as follows: ▪ Proposed Property Use (45%) ▪ Price (35%) ▪ Qualifications (15%) ▪ Timeline 7. Selection. The Millcreek City Manager will select the Evaluation Committee. This committee will score the proposals and make recommendation to the Millcreek City Council. The City Council will make the final award of contract. The award of contract is scheduled for discussion in the January 9, 2023 City Council Work Meeting, with the final awarding scheduled for the City Council Meeting of January 23, 2023. 8. General Information. City reserves the right to reject any and all Responses. The City reserves the right to amend, modify or waive any requirement set forth in this Request. Response to this Request is at the Proposer’s sole risk and expense. All Proposers must comply with applicable federal, state, and local laws and regulations. Except for written responses provided by the contact person described below, the City has not authorized anyone to make any representations regarding the subject matter of this Request. The City anticipates selecting one of the responding Proposers, but there is no guarantee that any responding Proposer will be selected. Responses will be placed in the public domain and become public records subject to examination and review by any interested parties in accordance with the Government Record Access Management Act (Utah Code Ann. § 63G-2-101, et seq.). All materials submitted in response to this Request will become the property of the City and will be managed in accordance with the Government Record Access Management Act. 9. Terms of Contract. The successful Proposer will be required to enter into a contract with the City to complete the transaction described herein. If the selected Proposer and the City Attorney are unable to negotiate an acceptable agreement, then another Proposer(s) will be selected by the City Manager, or his designee, and negotiation will continue with such other Proposer(s) until an acceptable agreement is completed. 10.
