January 2025 Millcreek Together Code Update I 18.76 Special Business Land Use Regulations Summary Sheet Chapter 18.76 Special Business Land Use Regulations Summary A. Purpose. The purpose of this chapter is to describe additional requirements for certain businesses to minimize nuisance and land use conflict. This chapter covers home businesses, commercial daycares and preschools, home daycares and preschools, and sexually oriented businesses. B. What Changed. o Currently, standards for these business types are spread throughout the code. As part of the code update, staff is proposing to place all special business land use regulations into one chapter. o Substantively, most of the proposed requirements are the same as those currently in effect, with the following exceptions: o Sexually-oriented businesses are limited to the M Zone (currently, they are allowed in a C-3 zone, which the new code proposes to eliminate) o Home business activities are proposed to be allowed in detached garages. Currently, home business activities are only allowed in a garage if it is attached to the main dwelling. C. What Remained the Same. o Most of the proposed requirements are identical to those currently in effect. D. Rationale for Changes. These changes were made for ease of readership. Additionally, due to changes in the C zones, staff determined that allowing Sexually-oriented businesses in the M zone would be sufficient, under the federal statutory requirements for such businesses. Many Millcreek homes have detached garages. Staff recommends allowing home businesses in detached garages to broaden opportunities for Millcreek residents to conduct businesses appropriately from their homes.
