A CRA is one of the tools available to local communities to help bring about positive change consistent with a community’s vision. A CRA may provide public assistance to redevelop underutilized and undervalued properties, in addition to updating infrastructure and eliminating conditions that contribute to existing statutory conditions of blight. The Agency began the process of creating a CRA by adopting a resolution on May 14, 2018 under subsection 17C-5-103 designating a blight study “survey area” located along both sides of 3300 South, between 900 South to the west and Highland Drive to the east. The survey area is referred to herein as the Millcreek Center CRA Survey Area. To determine the existence of blight within a CRA, a blight study was commissioned by the Agency and performed by Lewis Young Robertson & Burningham, Inc. (LYRB). The Statutory conditions that must exist in the survey area for the agency board to make a finding of blight are specified in Title 17C, “Limited Purpose Local Government Entities – Community Reinvestment Agency Act.” These conditions include a variety of factors including but not limited to physical and environmental conditions as well as conditions which endanger life or property by fire and other causes. The finding of blight is a compilation of these conditions, as Utah Code specifies that at least four1 of the conditions that constitute blight must exist in the survey area to make a finding of blight. Using a blight survey form2 based on Utah Code 17C-5-405 and Millcreek Municipal Code3, a visual inspection of each parcel in the survey area was then conducted by LYRB.4 Multiple factors were considered for each statutory blight determinant. For example, some of the factors considered for blight determinant (substantial physical dilapidation, deterioration or defective construction of buildings or infrastructure) include broken windows, foundation damage, exterior rot/rust, cracked or peeling paint, roof condition and low/hazardous power lines. The applicable “factor box” for each statutory determinant was checked on the survey form and a determination of “blight” or “no blight” was made based on the extent each factor was present and contributed to the overall appearance and functionality of the building/property. Additionally, a detailed picture(s) of the factors that contributed to the determination of blight were taken for parcels that met the statutory conditions of blight. In addition to the qualitative analysis described above, a quantitative analysis was conducted for blight determinants 17C-5-405 criminal activity in the survey area, higher than that of comparable non-blighted areas in the municipality or county and 17C-5-405 excessive vacancy. For blight determinant LYRB calculated the average annual number of criminal activities in the survey area per parcel and considered parcels with double the average as criminally blighted. For blight determinant parcels with vacant buildings/suites were only blighted if they were 100 percent vacant. It is important to note that the determination of blight applies to an area as a whole and not to individual parcels. The determination of blight for a project/survey area is dependent on the extent to which the individual parcels are affected by the presence of statutory conditions that exist on the individual parcels in the survey area. Utah law recognizes that the presence of the conditions that constitute blight “substantially impair the sound growth of the municipality, delays the provision of housing accommodations, or constitutes an economic liability or is detrimental to the public health, safety, or welfare”5 in an area’s present condition and use. 1 Utah Code Section 17C-5-405 (1)(a)(iv) 2 A copy of the blight survey form is included at the end of this report. 3 City personnel were contacted in order to identify city municipal code pertinent to Utah Code 17C-5-405 4 A minimum of two representatives from LYRB were present on each visual inspection. 5 Utah Code Section 17C-5-405-(1)(a)(iv) ---PAGE BREAK--- Page I 4 Section 2: Survey Area The location that was evaluated for the creation of a community reinvestment project area comprised of approximately 447 parcels located in Millcreek City. The survey area boundaries run along both sides of 3300 South, between approximately 900 East on the west and Highland Drive to the east. All the survey area is urban in nature and zoned for general commercial and residential use. Approximately 3 percent of the parcels are vacant. There are no agricultural, forest or mining uses in the survey area. Figure 1: Illustration of Millcreek Center Survey Area ---PAGE BREAK--- Page I 5 Section 3: State Law Regarding Conditions that Constitute Blight Section 17C-5-405, specifies the following conditions be evaluated in connection with the determination of blight. A board may not make a finding of blight in a resolution under Subsection 17C-5-402(2)(c)(ii) unless the board finds that: the survey area consists predominantly of non-greenfield parcels; (ii) the survey area is currently zoned for urban purposes and generally served by utilities; (iii) at least 50 percent of the parcels within the survey area contain nonagricultural or non-accessory buildings or improvements used or intended for residential, commercial, industrial, or other urban purposes; (iv) the present condition or use of the survey area substantially impairs the sound growth of the community, delays the provision of housing accommodations, constitutes an economic liability, or is detrimental to the public health, safety, or welfare, as shown by the existence within the survey area of at least four of the following factors: although sometimes interspersed with well maintained buildings and infrastructure, substantial physical dilapidation, deterioration, or defective construction of buildings or infrastructure, or significant noncompliance with current building code, safety code, health code, or fire code requirements or local ordinances; unsanitary or unsafe conditions in the survey area that threaten the health, safety, or welfare of the community; environmental hazards, as defined in state or federal law, which require remediation as a condition of current or future use and development; excessive vacancy, abandoned buildings, or vacant lots within an area zoned for urban use and served by utilities, abandoned or outdated facilities that pose a threat to public health, safety, or welfare; criminal activity in the project area, higher than that of comparable non-blighted areas in the municipality or county; and defective or unusual conditions of title rendering the title non-marketable; and at least 50% of the privately-owned parcels within the survey area are affected by at least one of the factors, but not necessarily the same factor, listed in Subsection and the affected parcels comprise at least 66% of the privately-owned acreage within the survey area; or the proposed project area includes some or all a superfund site, inactive industrial site, or inactive airport site. A single parcel comprising 10% or more of the acreage within the survey area may not be counted as satisfying Subsection (1)(a)(iii) or (iv) unless at least 50% of the area of the parcel is occupied by buildings or improvements. Except as provided in Subsection for purposes of Subsection if a participant or proposed participant involved in the project area development has caused a condition listed in Subsection (1)(a)(iv) within the survey area, that condition may not be used in the determination of blight. Subsection does not apply to a condition that was caused by an owner or tenant who becomes a participant. ---PAGE BREAK--- Page I 6 Section 4: Summary of Blight Findings on Entire Survey Area The survey area consists 447 parcels. The total acreage for the survey area is approximately 164 acres. UCA17C-5-405(1)(a)(i) There are no greenfield6 parcels in the survey area UCA17C-5-405(1)(a)(ii) 100 percent of the parcels in the survey area have access to utilities.7 The survey area parcels are currently zoned for urban purposes. UCA17C-5-405(1)(a)(iii) 92 percent of the parcels within the survey area contain nonagricultural or non-accessory buildings or improvements used or intended for residential, commercial, industrial, or other urban purposes. UCA17C-5-405(1)(a)(iv) The present condition or use of the survey area substantially impairs the sound growth of the community, delays the provision of housing accommodations, constitutes an economic liability, or is detrimental to the public health, safety, or welfare, as shown by the existence within the survey area of at least four of the following factors: Statutory Factor o – “Substantial physical dilapidation, deterioration, or defective construction of buildings or infrastructure” exists on 33 percent of the parcels in the survey area; or o (II) – “Significant noncompliance with current building code, safety code, health code, or fire code requirements or local ordinances” exists on 40 percent of the parcels in the survey area. Statutory Factor – “Unsanitary or unsafe conditions in the proposed project area that threaten the health, safety, or welfare of the community” exist on 20 percent of the parcels in the survey area. Statutory Factor – “Environmental hazards, as defined in state or federal law that require remediation as a condition for current or future use and development” exist on 1 percent of the parcels. Statutory Factor – “Excessive vacancy, abandoned buildings, or vacant lots within an area zoned for urban use and served by utilities” exists on 4 percent of the parcels.8 Statutory Factor – “Abandoned or outdated facilities that pose a threat to public health, safety, or welfare” exist on 0 percent of the parcels. The affected parcels only compromise 54 percent of the acreage of the survey area. Thus, the Agency has selected a portion of the survey area where there is a higher concentration of statutory factors that “impair the sound growth of the community, delays the provision of housing accommodations, constitute an economic liability or [are] detrimental to the public health, safety, or welfare as the proposed blight survey area. The proposed blight survey area is located along both sides of 3300 South, between approximately 900 East on the west and Highland Drive to the east. It excludes some of the residential parcels along Elgin Avenue, Riches Avenue and 1000 East. The proposed survey area is comprised of approximately 372 parcels totaling approximately 112 acres located in Millcreek City. The required criteria for blight is sufficiently found within this area. The total acreage for the survey area is approximately 112 acres. UCA17C-5-405(1)(a)(i) There are no greenfield11 parcels in the survey area UCA17C-5-405(1)(a)(ii) 100 percent of the parcels in the survey area have access to utilities.12 The survey area parcels are currently zoned for urban purposes. UCA17C-5-405(1)(a)(iii) 87 percent of the parcels within the survey area contain nonagricultural or non-accessory buildings or improvements used or intended for residential, commercial, industrial, or other urban purposes. UCA17C-5-405(1)(a)(iv) The present condition or use of the survey area substantially impairs the sound growth of the community, delays the provision of housing accommodations, constitutes an economic liability, or is detrimental to the public health, safety, or welfare, as shown by the existence within the survey area of at least four of the following factors: Statutory Factor o – “Substantial physical dilapidation, deterioration, or defective construction of buildings or infrastructure” exists on 44 percent of the parcels in the survey area; or o (II) – “Significant noncompliance with current building code, safety code, health code, or fire code requirements or local ordinances” exists on 40 percent of the parcels in the survey area. Statutory Factor – “Unsanitary or unsafe conditions in the proposed project area that threaten the health, safety, or welfare of the community” exist on 21 percent of the parcels in the survey area. Statutory Factor – “Environmental hazards, as defined in state or federal law that require remediation as a condition for current or future use and development” exist on 1 percent of the parcels. The proposed blight survey area is blighted based on the criteria established under Utah Code 17C-5-405. The existing zoning in the entire survey area and the proposed blight survey area is conducive to a community reinvestment project area. The Millcreek Center Project Area ant its businesses will benefit from the addition of public and private investment in the proposed project area through, but not limited to, infrastructure improvements, crime reduction, monetary assistance for existing businesses, employment opportunities and new development. Based on the findings contained in this report, a recommendation is made that a resolution of blight be adopted for the proposed blight survey area portion of the project area, by reason of the following factors: Substantial physical dilapidation, deterioration, or defective construction of buildings or infrastructure exists on 44 percent of the parcels; Significant non-compliance with current building code, safety code, health code, or fire code requirements or local ordinances exists on 40 percent of the parcels; Unsanitary or unsafe conditions that threaten the health, safety, or welfare of the community exists on 21 percent of the parcels;
