January 2025 Millcreek Together Code Update I 18.25 Subdivision Code Summary Sheet Chapter 18.24 and 18.25 Subdivision Code Summary A. Purpose. The purpose of this chapter is to establish standards for the development and construction of subdivisions in Millcreek that comply with all applicable zoning, building, health, and fire requirements, including but not limited to, all adopted use and development standards adopted by Millcreek. B. What Changed. o New standards for flag lot subdivisions. o Processes laid out in better form and with clearer step-by-step instructions. o Creates different application standards for minor or major subdivisions. o Clarifies lot standards for new subdivisions. o Technical changes to meet state requirements. o Changed standards for lots, parcels, and buildings on a private street. Currently, there are broad exceptions available for this type of development, and requires a cumbersome secondary approval process. Staff is proposing minimum width standards, maximum length standards, and appropriate minimum setbacks from private streets, that can be approved administratively. C. What Remained the Same. o Most of the substance and procedure is the same, with updated language for clarity. o Engineering requirements and standards have not changed. o Required fees and bonding requirements have not changed. D. Rationale for Changes. The update of the subdivision code was necessitated to meet changing state subdivision regulations. At the same time, issues with the existing flag lot code and processes for subdivision applications made for a good opportunity to fix multiple issues with one stroke. This updated code section has been adopted and enforced since April 2023.
