Millcreek 3330 South 1300 East Millcreek, UT 84106 Request for Proposals Business License Fee Study due April 26, 2019 at 10:00 a.m. local time 1. Introduction. Millcreek (the “City”) is requesting proposals (“Proposals” or “Responses”) from qualified proposers (“Proposers”) to complete a study/analysis of the City’s business license fees (“Services”). 1.1. Intent. It is the intent of this Request for Proposals (this “Request”) to set forth the minimum acceptable requirements for Responses to this request. 2. Background and Detailed Description of Services. The City was incorporated in December of 2016 and has an approximate population of 62,000 residents. The City currently has approximately 4,000 licensed businesses; 3,000 commercial and 1,000 home-based. The City requests a study that satisfies all the requirements of Utah Code Ann. § 10-1-203 including evaluation of business class classification. Proposer will also provide a table of comparative business license fees from similarly situated cities. The City’s current fee schedule contains business license application fees, including commercial and home-based businesses, “per-employee” fees, one-two dwelling rental fees, renewal fees, late penalties, solicitor/vendor licenses, alcohol licenses, food truck licenses, sexually-oriented licenses, and other business-related fees. A more detailed description of the Services is attached hereto as Exhibit 3. Proposal Requirements. Two written copies and an electronic copy in PDF (Portable Document Format) of the Proposal are required to be submitted to Audrey Cullimore, Business License Administrator as listed below, no later than 10:00 a.m. local time on April 26, 2019. Any response, modification, or amendment received after the due date and time is considered late. No late response, modification, or amendment will be accepted. No electronic Responses will be accepted. Proposals must include the following elements and be signed by an authorized representative of the Proposer: 3.1. Introductory Letter. An introductory letter expressing an interest in providing the Services should be included. Qualifications. Describe, in sufficient detail, the Proposer experience in analyzing municipal business license fees, Disproportionate Fees, and related permit and application fees, preferably in the state of Utah or surrounding states. 3.3. Timeline. Describe, in sufficient detail, the timeline for delivery of the Services. 3.4. Cost. Provide a detailed fee schedule that includes a total “not-to-exceed” price to complete the project that includes any and all fees and any and all costs the Proposer may incur, including any costs for transportation, lodging, communication, printing, etc. 3.5. References. Include the name, address, and contact person of at least three government agencies with which the Proposer has provided similar type Services. The City may contact such references. 4. Identification of Anticipated Potential Problems. Proposals should identify and describe any potential problems with respect to providing the Services. 5. Evaluation Criteria and Scoring Process. Proposals will be opened at 10:01 a.m. on April 26, 2019 at Millcreek City Hall. All Proposals received will be reviewed by the Evaluation Committee. Each evaluation criterion has been given a percentage based on its relative value as a whole. The criteria and each associated percentage are as follows: Qualifications (30%) Timeline (30%) Cost (30%) References (10%) 6. Selection. Discussions may be conducted with Proposers determined by the Business License Administrator to be reasonably susceptible of being selected for the award. In addition, one or more Proposers may be invited to interview, provided; however, Proposals may be accepted without discussion or interview. The Mayor or his designee will make the award. 7. General Information. City reserves the right to reject any and all Responses. The City reserves the right to amend, modify or waive any requirement set forth in this Request. Response to this Request is at the Proposer’s sole risk and expense. All Proposers must comply with applicable federal, state, and local laws and regulations. Except for written responses provided by the contact person described below, the City has not authorized anyone to make any representations regarding the subject matter of this Request. All requests for clarification or additional information regarding this Request must be submitted in writing to the contact person described below no later than April 25, 2019 at 12:00 p.m. The contact person will endeavor to ---PAGE BREAK--- Request for Proposals respond to such request for clarification or additional information and if the contact person deems, in her sole and absolute discretion, that such response is of general applicability, her response, if any, will be posted on the City’s website at Millcreek.us (which constitutes a written response). Entities responding to this Request are encouraged to review such website frequently. The City anticipates selecting one or more of the responding Proposers, but there is no guarantee that any responding Proposer will be selected. Responses will be placed in the public domain and become public records subject to examination and review by any interested parties in accordance with the Government Record Access Management Act (Utah Code Ann. § 63G-2-101, et seq.). All materials submitted in response to this Request will become the property of the City and will be managed in accordance with the Government Record Access Management Act. 8. Terms of Contract. The successful Proposer will be required to enter into a contract with the City to provide the Services. If the selected Proposer and the City Attorney are unable to negotiate an acceptable agreement, then another Proposer(s) will be selected by the Mayor or his designee and negotiation will continue with such other Proposer(s) until an acceptable agreement is completed. 9. For more information on the Proposal, contact Audrey Cullimore, Business License Administrator, [EMAIL REDACTED], 3330 South 1300 East, Millcreek, UT 84106 or for American with Disabilities Act (ADA) accommodation, contact Alexandra Muller, ADA Compliance Officer, [EMAIL REDACTED], 3330 South 1300 East, Millcreek, UT 84106. ---PAGE BREAK--- Exhibit Detailed Description of Services • Ensure that the Services are based on substantial evidence and is consistent with all applicable state and federal laws. • Propose a new business license fee schedule for all businesses within the City including: o Review the existing business license and regulations ordinance and work with City staff to determine outdated and inappropriate elements. o Propose a business license fee schedule in an amount that is reasonably related to the costs of Millcreek’s services that satisfies the requirements of current State law (for example Utah Code Ann. § 10 203). o Conduct periodic coordination meetings with City staff and designees to review progress and discuss issues. o Evaluate the current adopted fee schedule and classification of businesses and provide a recommendation of action to Millcreek which will also include a table of comparative fees from similarly situated cities. o Coordinate with city staff on the approval of the revised business license and regulation ordinance by the City Council that satisfies the requirements of current State law and City policy (for example Utah Code Ann.§ 52-4-101 et seq.). o Attend and participate as directed by Millcreek in presentations to the City Council and other meetings the City deems necessary on the research and analysis, proposed new fee schedule, and business license and regulation ordinance. o Provide analysis and input regarding the revised business license ordinance (based on proposed business license fee schedule) of the City business license and regulation ordinance.
