January 2025 Millcreek Together Code Update I 18.01 – 18.04 General Provisions Summary Sheet Chapters 18.01 – 18.04 General Provisions, Enforcement, and Appeals A. Purpose. These chapters establish generally provisions including the relationship between the code and other ordinances, the general plan, and the transportation master plan. This language is typical to most zoning ordinance, and clarifies the requirements for building permits and compliance with zoning ordinances. B. What Changed. o The current code has a set of enforcement procedures that conflicts with the streamlined enforcement procedures Millcreek set up for code enforcement matters in Chapters 1.16 and 1.18. The revised ordinance simply makes references to the processes for code enforcement found in these chapters. o The authority of the Planning Commission and the Land Use Hearing Officer were moved to a new chapter, 18.03. o Appeals were moved to a new chapter, 18.04. C. What Remained the Same. o Substantial sections remained the same from the current code, or were adjusted to modernize wording. o The language for the Planning Commission and Land Use Hearing Officer substantially remains the same, but was adjusted pursuant to a legal review to ensure compliance with state law. D. Rationale for Changes. o Currently, these concepts are spread throughout the code. The changes summarized above were intended to consolidate the land use authority, appeal authority, and general provisions into one series of chapters at the beginning of the code.
