W-1 WAGE RATES It is the total cost of a project constructed during the construction season that is used in the determination of whether wage rates are required, not the breakdown of the various contracts within the project. For any project, if wage rates are not requested and it is determined by DWD after award of the project that wage rates are in fact necessary, DWD has the authority to require that the wage rates be included in the project by change order or require that the project be rebid. The reverse is not true. If a project is bid with wage rates and the project comes in under the threshold level, wage rates still apply, i.e., wage rates cannot be deleted from a project cost once a wage rate determination has been made unless the project is re-bid. These DWD comments should be kept in mind when evaluating the need for wage rates on a particular project, especially when probable project costs are near the threshold level. The application form for a wage rate determination (DWD form ERD-5719) is updated annually by the DWD, and is effective on January 1 of the current year. Current application and other forms may be obtained from the DWD or may be printed from the DWD website, www.dwd.state.wi.us/dwd/forms. If wage rate determination is issued, bidding documents will include the following DWD documents: Prevailing Wage Rate Determination Disclosure of Ownership form (DWD form ERD-7777) Request to Employ Subjourneyperson form (DWD form ERD-10880) Contracts or Subcontracts may not be awarded to any debarred contractor as named on the “Consolidated List of Debarred Contractors” issued by the DWD with the wage rate determination. At the conclusion of the project, but prior to final payment: The Prime Contractor must receive and retain a completed “Agent or Subcontractor Affidavit of Compliance with Prevailing Wage Rate Determination” from each subcontractor (DWD form ERD-10584). The awarding agency must receive and retain a completed “Prime Contractor Affidavit of Compliance with Prevailing Wage Rate Determination” from the prime contractor (DWD form ERD-5724).
