FACILITY USE AGREEMENT CONDITIONS OF USE Rental Policy Statement: The Rental Facilities within the City of Marysville Parks, Culture and Recreation system are provided for public use(s). The Parks, Culture and Recreation Advisory Board has mandated that all facilities be self-supporting. In order to maintain the facilities the following fees and policies have been passed and must be adhered to. Rentals will be on a first come first serve basis with a maximum of one-year advance reservations. No City facility may be rented by the same individual, group or entity or individual who is a member of such group or entity more than twelve (12) times in any calendar year. Check-In/Check-Out: All facility users are to check in with the Park Caretaker or office no later than 30 minutes after the agreement arrival time and at the conclusion of all facility use. If unable to arrive by agreed arrival time, user is required to notify the Park Caretaker at (360) 651-5087. No keys will be given out. The Park caretaker is located behind the Parks Office in Jennings Park Building The user shall not leave the facility unattended at any time during the hours of use defined within this agreement. Office hours are Monday-Friday 8:00AM-5:00PM, closed 1:00-2:00PM for lunch. Cleaning: Final clean up of a facility is the responsibility of the user(s) and must be done immediately at the conclusion of use. Facility must be left in the same condition in which it was received. Cleanup responsibilities include sweeping of floors, all trash should be disposed of in trash receptacles, wipe down kitchen and tables, and replacement of all furniture used. The cost of any damage, additional cleanup or repair of any facility will be the responsibility of the user. Failure to perform any of the cleaning requirements may require additional fees. Decorations: Decorations, pictures, signs, notices, posters, displays or exhibits of any type may only be attached to the wall with poster putty. No staples, nails, screws, tape or any other devices that may cause damage to the exterior or interior of the building may be used. The use of any form of confetti, dry rice, or bird seed in or around the facilities is strictly prohibited. Any evidence of these may require additional fees. Piñatas are prohibited inside indoor facilities but may be used with outside shelters. The user is responsible for all clean up. Non-Profit Organizations: Use of public facilities for the purpose of generating personal financial gain is prohibited. Use of the facilities for the purpose of raising funds for non-profit organizations is accepted provided the non-profit organization furnishes a valid Federal Tax Identification Number and Non-Profit Status issued by the State of Washington and have prior approval by the Parks Director. The user is prohibited from charging any type of admission or entry fee requirement in rental facilities owned by the City of Marysville. RCW 42.17.555 prohibits use of public facilities for the purpose of directly or indirectly assisting in the campaign for election to public office. Damages: The user will be responsible for all breakage and damage done to furniture, appliances, kitchen equipment and damage to the building or utilities. Animals: No animals will be permitted inside facilities without appropriate notice and the written consent of the Parks, Culture and Recreation Department. The City maintains and enforces a leash law ordinance. Smoking and Alcohol: Smoking/vaping is prohibited in ALL City Parks as per MCC 6.82.173. Open containers of alcoholic beverages or consumption of alcohol is not allowed in any of the City of Marysville Parks as provided in City Ordinance 6.58.010 and RCW 66.44.100. Food: If a group or individual(s) provide their own food within the premises of a City facility, they assume all responsibility for the preparation, serving and consumption of the same and shall hold the City harmless from any liability arising therefrom. BBQ’s: Portable charcoal BBQ’s are prohibited in ALL City Parks. Gas BBQ’s are approved for outdoor use(s). Please have fire extinguisher on hand. Renters are to contact office prior to rental period for instructions and access routes. Entertainment: All entertainment involving acoustical or amplified music and/or use of electrical cords outside of indoor facilities must have prior approval from the Parks, Culture and Recreation Director. Liability: The party(s) or individual(s) signing a Facility Use Agreement assumes full financial responsibility for all damages that occur during or as a result of their usage of the facilities. The user understands that the City of Marysville shall not be responsible for accidents, injury, or loss of personal property. Payments: All Rental Fees are due at the time of reservation(s). Rental payment must be paid by cash, check/cashiers check, money order or Visa/MasterCard. No other forms of payment will be accepted. Refund Policy: Cancellations and/or requests for a refund must be in writing and received in the Parks & Rec Office (10) ten working days in advance of the rental date. Refund requests received in writing (10) ten working days in advance of the rental will be refunded less a $10 administrative fee. No refunds will be issued if the written request is received later than (10) ten working days prior to the rental date. Rental Rates for Jennings Park Barn: Facilities are available for rental between the hours of 8 AM to 10 PM Flat Rate Use (more than 4 hours): $125.00 Rental Fee Hourly Use (up to 4 hours): $20.00 per hour Rental Fee Non-Profit Organization Rate: $30.00 for up to 3 hours (Monday through Friday) All Outdoor Facilites: Facilities are available for rental between the hours of 8 AM to 9 PM, May - September Flat Rate Use: $75.00 Rental Fee City of Marysville Non-Discrimination Policy for Parks, Culture and Recreation Facilities and Programs The City of Marysville shall not discriminate in the use of City Parks, Culture and Recreation facilities or programs on the basis of race, creed, color, national origin, sexual orientation, sex, honorably discharged veteran or military status, status as a mother breastfeeding her child, the presence of any sensory, mental or physical disability, or the use of a trained dog guide or service animal by a person with a disability. In addition, neither the City nor a third party receiving a lease or permit from the City shall discriminate on the basis of sex in the operation, conduct, or administration of community athletic programs. Persons having questions or wishing to file a complaint regarding this policy may contact the City’s Director of Parks, Culture and Recreation. Use of the facilities for the purpose of raising funds for nonprofit organizations is accepted provided the non-profit organization furnishes a valid Federal Tax Identification Number and Non-Profit Status issued by the State of Washington. I/WE THE UNDERSIGNED, for and in consideration of permission being granted by the City of Marysville for the use by the undersigned of the City facilities hereby covenants and agrees to indemnify and keep indemnified the City of Marysville and all elected officials, agents and employees thereof, and to save the same harmless from and against any and all actions or causes of actions, claims, demands, liabilities, loss, damage or expense of whatsoever kind or nature, use of City Park property and facilities for the above described purpose by the undersigned. It is further understood and agreed, as a condition of the permission granted to the undersigned by the City of Marysville, that the undersigned and its agents shall at all times comply with all rules and regulations, and with all directions and instruction of City employees.
