Ken Baxter Community Center 514 Delta Ave [PHONE REDACTED] Facility Use Agreement General Information: Use of City of Marysville (“City”) facilities for generating income or for political events is prohibited. Raising funds for non-profit organizations is accepted with providing a valid Federal Tax Identification Number. The facility may not be used for any lewd conduct, gambling or illegal activity. Reservations: Rental applications are accepted first come, first serve. The facility can be booked up to one year in advance and we do not accept rentals with less than fourteen (14) days notice. Reservations are only accepted with full payment for all rental fees and damage deposit. Cancellations: To cancel the rental, the person (“User”) who completed the Rental Application provides written notice to the City. Rentals cancelled fourteen (14) days or more prior to the event are refunded 50% of the rental fees minus a $10 administrative fee. The City will retain all rental fees for rentals cancelled with less than fourteen (14) days notice. Rental Time: Rental time must include the event time AND any time needed for set-up and clean-up. The building will only be open and available for access during the time reserved. Check-In/Check-Out: The User checks-in with the on-site City staff person when they arrive and accepts the condition of the facility upon taking possession. The User checks out with staff at the conclusion of use to identify any necessary additional cleaning or damage to the facility. The User is responsible for returning the facility to its pre-event condition. This includes the removal of decorations and surface cleaning. Food Service: If food is provided, the User assumes all responsibility for the preparation, serving and consumption of the same and shall hold the City harmless from any liability arising there from. Entertainment: Fog machines or smoke generating devices are prohibited as they affect fire alarm systems. Any PA systems or DJ systems must be of normal amperage loads of 15 amps or less per circuit. The City is not responsible for any circumstances that occur due to excessive amperage loads placed on the system. No animals will be permitted without the written consent of the Parks, Culture and Recreation Department. Decorations: Decorations may not be attached, stapled, nailed or taped to exterior surfaces of the building or any interior surfaces other than the interior walls. Only approved command hooks, mounting putty or painters tape may be used to attach items to the interior walls. The use of confetti, rice or glitter is strictly prohibited. Open flames, including candles, are prohibited. Prohibited decorations or methods of attachment forfeits all damage deposits and the City may immediately terminate the rental use. Holiday Decorations: If renting in November or December, please be aware that the facility is decorated for the holidays with items such as holiday trees, ornaments and garlands. These decorations cannot be taken down during rentals. ---PAGE BREAK--- Damage Deposit: A damage deposit of $200 for rentals without alcohol and $300 for rentals with alcohol is due at the time of booking and is intended to guarantee that the terms of the Facility Use Agreement are followed. The damage deposit may be withheld, partially or in full, for going over the rental hours, being over capacity, failing to comply with applicable rules or laws, damage to the facility or inadequate cleaning. Any portion of the damage deposit to be returned will be returned to the person listed on the rental contract by check within three to five weeks. Alcohol: Alcohol is allowed during rentals with the permission of the Director or designee and compliance with the terms provided below. Only beer, wine and champagne are permitted. Absolutely no hard liquor or alcohol exceeding 15% is permitted under any circumstances. Open containers or alcohol consumption is not allowed outside of the facility. The User must also comply with the following: 1) Appropriate License and Enforcement. User must obtain a Banquet Permit from the Washington State Liquor and Cannabis Board fourteen (14) days or more prior to the rental. Banquet Permits cost $11 and can be purchased at The User is responsible for strictly complying with all requirements of such permits. The User is responsible for ensuring that only persons who are of legal age are permitted to consume alcohol at the facility. The City of Marysville is not responsible for the supervision or monitoring of the activity taking place at the facility. However, if a City employee observes any condition of this Facility Use Agreement or state liquor laws or regulations being violated, the City may immediately terminate the event and may request local law enforcement respond. 2) Insurance Requirements: User shall procure and maintain event insurance against claims for injuries to persons or damage to property which may arise from or in connection with the use of the facility and the activities of the User and his or her or its guests, representatives, employees and volunteers. User is required to procure General Liability Insurance. The “City of Marysville” must be named as additional insured. The endorsement shall add “The City of Marysville, its officials, officers, employees, agents, and volunteers” as additional insureds. The General Liability insurance shall be written with limits not less than $1,000,000 each occurrence and $2,000,000 general aggregate. User shall additionally procure and maintain Liquor Liability insurance in the amount of $1,000,000 each occurrence. The “City of Marysville” is to be named as an additional insured on the Liquor Liability insurance policy. User may use their own insurance company or may purchase at Our Venue ID Code is 0465-090 and the cost is around $150. Liability: The User assumes full financial responsibility for damages that occur during or as a result of their facility use. This includes all breakage or damage done to furniture, appliances, kitchen equipment, building or utilities. Any damage to the facility or additional necessary clean-up forfeits the damage deposit and may incur additional charges. The User understands that the City shall not be responsible for accidents, injury, or loss of personal property. Rental Policy Statement: Rental spaces within the City parks are provided for public use. The Marysville Parks & Recreation Advisory Board has mandated that all facilities be self-supporting. Terms and conditions in this Facility Use Agreement and the rental fees have been set in order to protect and maintain the facilities. The City of Marysville does not discriminate against any participant, client, or user of any services because of race, creed, color, religion, national origin, marital status, sex, sexual orientation, age, or handicap and fully complies with the Americans with Disabilities Act.
