The Finance Committee reserves the right to accept or reject any and all proposals. Beauparlant Director of Budget/Purchasing NJB/syt ---PAGE BREAK--- City of Lewiston, Maine Department of Public Works Sidewalk & Roadside Weed Control Services Bid 2013-006 Bid Date: February 26, 2013 The City of Lewiston, Department of Public Works is seeking bids for sidewalk and roadside weed control services for the period of July 1, 2013 through June 30, 2014. The City of Lewiston reserves the right, at its sole discretion, to extend the contract for two additional one year periods (July 1, 2014 - June 30, 2015 and July 1, 2015 - June 30, 2016). The following specifications shall be the minimum requirements. The factors to be considered in awarding the contract, shall be services provided, cost and references. The City of Lewiston reserves the right to reject any and all bids, when deemed to be in the best interest of the City and to waive any minor discrepancy or technicality in the bid specifications. Bids shall be submitted to the Director of Budget/Purchasing, City Hall, 27 Pine Street, Lewiston, Maine 04240 on Tuesday, February 26, 2013 by 2:00 p.m. and then at said office opened and read aloud. SPECIFICATIONS The contracted firm shall: • Provide herbicide treatment to control emergent weeks along curbing, sidewalks, guardrails and traffic islands on designated streets and all other incidental work as necessary to satisfactorily provide the services as outlined or implied in the Specifications. Please refer to attached map and list of areas. The quantities stated in the “Contract and Proposal” are estimates and it is the responsibility of the contractor to visit the site and verify the quantities. All designated sidewalks, roadsides and traffic islands will receive herbicide applications once per month during the months of July, August and September 2013 and June 2014. • Obtain all required permits, licenses, certificates and inspections, both permanent and temporary. The contractor and staff shall be licensed and authorized to do this specific type of work within the State of Maine. • Perform the work at those times of the day when there are few or no members of the general public present (night time work would be acceptable). • Furnish all labor, signage, traffic control (barriers and/or flaggers as may be applicable), chemicals/materials, protective clothing, transportation and equipment necessary to perform the work in accordance with the best trade practices. • Coordinate the schedule for the performance of any work associated with the contract (including identifying the date and approximate time of day each street/area is to receive herbicide applications) with the City Arborist. ---PAGE BREAK--- • Provide two copies of all M.S.D.S. for all products and materials to be used in the performance of this contract prior to performing any work. The M.S.D.S. will be provided to the Department of Public Works, City Arborist and the Department of Public Works Safety, Training and Lost Time Coordinator. • Remove and properly dispose of all waste material generated by the contracted firm. • CLAIMS: The City of Lewiston will not be held responsible for any damages or injuries arising out of any activity for the City. Any related claim will be referred to the Contractor. The contractor may wish to make personal restoration within a reasonable amount of time at the property owner’s satisfaction or process a claim with their insurance carrier. • • INSURANCE: The Contractor shall furnish proof of coverage with adequate insurance of the types and to the limits specified below naming the City of Lewiston as additional insured. Certificate of such insurance shall be filed with the Director of Budget/Purchasing by five days following notification of the bid award WORKERS’ COMPENSATION: Workers’ Compensation, coverage with Statutory Limits and Employers Liability for all employees with limits of $400,000 per incident; and in case any work is sublet, the Contractor shall require the sub-contractor similarly to provide coverage for the latter’s employees unless such employees are covered by the protection afforded the Contractor. AUTOMOTIVE LIABILITY INSURANCE: Automotive Liability insurance with minimum limits of liability for bodily injury in the amount of $400,000 for each occurrence and minimum limits of liability for property damage in the amount of $50,000/$100,000 aggregate. GENERAL LIABILITY INSURANCE: General Liability insurance with minimum limits of liability for bodily injury in the amount of $500,000 for each occurrence and minimum limits of liability for property damage in the amount of $50,000/$100,000 aggregate, or a combined single limit of $500,000 for each occurrence, including completed operations shall be required. • Provide employees who conduct themselves in a neat and professional manner, placing an emphasis on being courteous under any and all situations, which may occur. • Be in compliance with, and continue to maintain any and all State and Federal Regulations, which pertain to Work Zone Traffic Control as described in the “Manual on Uniform Traffic Control Devices”. • Instruct employees they shall coordinate their services in conjunction with the supervisor or his/her designee of the various construction and maintenance projects. • Provide the City with a list of references including names, addresses and telephone numbers of the firm, contact person and length of the services provided. • Remove any employee(s) who are not performing to the standards set forth in this bid specification or as requested by the City, and replace them with qualified replacements. Should additional applications or areas be added, the same scope of work described above shall be utilized. The contractor shall provide the following unit prices to be used in identifying pre-priced contract cost adjustments should modifications to the contract be required. The execution of these options is dependent upon funding availability and continued service requirements.
