The Finance Committee reserves the right to accept or reject any and all proposals. Please use a sealed envelope clearly marked with the bid name and number when submitting your bid. The City of Lewiston is seeking bids for removal and recycling of the following waste material Scrap Metal. Definitions a. Scrap Metal – includes white goods (large appliances, such as refrigerators, freezers, wall mounted air-conditioners, stoves, washing machines, etc.) and other waste metals generated through small maintenance & construction / demolition projects. Scrap Metal does not include engines, gear boxes, or enclosed tanks / vessels, which contain chemicals or lubricants. b. Gross ton equals 2,240 pounds. c. Net ton equals 2,000 pounds. 2. The duration of the bid is for two years from the date of Finance Committee approval. 3. Bid price for scrap metal shall be based on a percentage of the American Metal Market’s Scrap Iron & Steel Price for No. 1 Heavy Melt. This price shall be adjusted on a basis, as needed, to reflect the current market price of No. 1 Heavy Melt. Copies of the American Metal Market’s Scrap Iron Price Sheet shall be provided to the Superintendent of Solid Waste on request for verification of market pricing. The bidding contractors price shall reflect the percentage of the current Boston Export Market price of No. 1 Heavy Melt. The contractor shall completely remove the scrap metal on a regular basis; at a maximum of every 45 days. Initially, the contractor shall remove the scrap metal within 14 days of approval of the bid. The contractor shall also have the capability of removing the scrap metal pile within one week of being notified by the City. 4. The average annual net tonnage of scrap metal generated – 392. 5. All solid waste (as defined) to be removed is located at the Lewiston’s Solid Waste Facility at 424 River Road, Lewiston Maine. 6. The Solid Waste Facility has vehicle accessibility. ---PAGE BREAK--- 7. The contractor shall remove all scrap metal (as defined) from the Solid Waste Facility. The contractor shall not have the right to pick and choose what he wants. The areas where the scrap metal is stockpiled shall be broom swept and left clean by the contractor once all metal has been removed from the scrap metal storage area. 8. Prices quoted for scrap metal shall reflect a percentage of the per ton cost as represented in the American Metal Market’s Scrap Iron & Steel Price listing. Prices quoted in the American Metal Market’s Scrap Iron & Steel Price listing are in U.S. dollars per gross ton. 9. All scrap metal (as defined) shall be loaded and removed by the contractor with their equipment and labor during normal Solid Waste Facility hours. The hours are from 7:15 A.M. to 2:45 P.M., Monday through Friday, and 8:00 A.M. to 12:00 P.M., Saturday. 10. The scrap metal contemplated for recycling may be inspected by the bidder prior to the bid date by making an appointment with the Solid Waste Facility Superintendent. 11. All prices quoted shall for the solid waste as is, where is. 12. The scrap metal (as defined) shall be weighed at the Solid Waste Facility by a Solid Waste Facility employee. Payment shall be based on weights recorded at the Solid Waste Facility Scale House. 13. All bids shall be subject to Finance Committee Approval. 14. The City reserves the right to accept/reject any and all bids and to award individual items to different contractors, or as a package, whichever is in the City’s best interest. 15. In compliance with the Clean Air Act, all freon from refrigerators and air conditioners must be removed and collected, as described in current statutes and regulations, prior to removal of the appliances. This can be provided by the Contractor if both bid items are awarded to him, or if the contractor is awarded only item the City shall make arrangements for the removal of the freon prior to removal of the scrap metal by the contractor. All units that have been properly vented of freon shall have a City sticker affixed to it. The contractor may provide a bid for the removal of freon from refrigeration units and air conditioners in order to provide this service. If requested, the contractor shall remove the freon, as described in current statutes and regulations, prior to removing the scrap metal and shall keep all records as required by the City. The cost of the freon removal shall be subtracted from the total value of the scrap metal removed. 16. If for any reason the contractor is unable to meet the terms of the contract, the City reserves the right to cancel the contract and resubmit it for bid by giving 30 days written notice to the contractor. 17. The Contractor shall take all responsibility of the work and take all precautions for preventing injuries to persons and property in or about the work; shall bear all losses resulting to him/her on account of the amount or character of the work or because the nature of the land in or on which the work is done is different from what was estimated or expected or on account of the weather, elements or other cause; and he/she shall assume the defense of and indemnify and save harmless the City and its officers, agents and servants from all claims relating to labor and ---PAGE BREAK--- materials furnished for the work; to inventions, patents and patent rights used in doing the work; to injuries to any person or corporation received or sustained by or from the Contractor and his/her employees in doing the work, or in consequence of any improper materials, implements or labor used therein; and to any act, omission or neglect of the Contractor and his/her employees therein. The Contractor shall procure and maintain for the life of this Contract insurance of the types and to the limits specified below. Certificates of such insurance showing policies and adequacy of protection shall be filed with the Purchasing Agent for his/her approval before permission to commence work will be granted. Workmen's Compensation Insurance for all employees employed at the site of the project; and, in case any work is sublet, the Contractor shall require the sub-contractor similarly to provide coverage for the latter's employees unless such employees are covered by the protection afforded the Contractor; all coverages to be in accordance with State of Maine laws in effect and the requirements of the Industrial Accident Commission. General Liability Insurance with minimum limits of liability for bodily injury in the amount of $500,000 combined single limit and minimum limits of liability for property damage in the amount of $100,000 combined single limit. General liability coverage shall include Owners' or Contractors’ Protective, Product and Completed Operations, Comprehensive, Explosion Collapse and Underground coverages. Automotive Liability Insurance with minimum limits of liability for bodily injury in the amount of $500,000 for each occurrence and minimum limits of liability for property damage in the amount of $100,000.
