REGULATIONS PERTAINING TO ADULT AMUSEMENT DEVICE LICENSEES 1 I. STATEMENT OF FINDINGS AND PURPOSE The City finds that: a. Many adult amusement device licensees provide booths in which patrons can utilize adult amusement devices. b. Said adult amusement device booths have been used by patrons as a location in which to engage in sexual acts, sexual contact and masturbation. c. Said adult amusement device booths have therefore been repeatedly contaminated with semen which has been determined to be a potentially infectious material by the Occupational Safety and Health Administration of the United States. d. The use of said adult amusement device booths for the commission of sexual acts, sexual contact and masturbation have resulted in unsafe and unsanitary conditions in the booths of licensed establishments. e. The purpose of these regulations is to govern the operation of adult amusement device licensed premises in a manner which protects and promotes the health, safety and welfare of the citizens of Lewiston. II. APPLICABILITY These regulations shall apply to all persons holding an adult amusement device license issued by the City. III. COMPLIANCE DEADLINE FOR EXISTING LICENSEES All persons holding, on the date of enactment of these regulations, an adult amusement device license issued by the City shall comply with all provisions of these regulations within sixty (60) days of the date of enactment thereof. IV. STANDARDS a. No viewing area, booth or cubicle in which any adult amusement device is located may be occupied by more than one person at a time. b. Each viewing area, booth or cubicle in which an adult amusement device is located shall be illuminated during all hours of operation by a minimum of 1.0 foot candle, as measured at the floor level. c. Each viewing area, booth or cubicle in which an adult amusement device is located shall be physically constructed and arranged in such a manner that the entire interior thereof is clearly visible from the common areas of the licensed premises. ---PAGE BREAK--- REGULATIONS PERTAINING TO ADULT AMUSEMENT DEVICE LICENSEES 2 No wall of such a viewing area, booth or cubicle shall be lower than 42 inches from the floor thereof such that all areas of said viewing area, booth or cubicle below that height are clearly visible from the common areas of the licensed premise. Visibility into such viewing areas, booths or cubicles shall not be blocked or obscured by doors, curtains, partitions, drapes or any other obstruction. d. No licensee shall, within any licensed premise, permit any person to engage in masturbation or the commission of any sexual act or sexual contact as defined in 17-A M.R.S.A., Section 2. e. Except as provided herein, no wall of any viewing area, booth or cubicle in which an adult amusement device is located shall have any aperture, hole or other opening. f. No licensee shall permit the presence of any minor within a licensed premise. g. All interior surfaces of every viewing area, booth or cubicle containing any adult amusement device shall be composed of smooth textured, nonabsorbent and easily cleanable material. h. All licensed premises shall be maintained in a clean and sanitary condition at all times. V. EFFECTIVE DATE These regulations shall be effective on their date of enactment by the City Council.
