Note: This penalty is outlined in the City Code of Ordinances Chapter 1 General Provisions. Chapter 14 Animals - Penalties A fine of no less than $160.00 for each of the first and second violation. The minimum penalty for any subsequent violation shall be $530.00, for each offense. Note: This penalty is outlined in the City Code of Ordinances Chapter 14, Article I. In General. Chapter 14 Animals - Penalties A minimum financial penalty for a violation of this section is $525.00 for the first offense; $700.00 for the second offense; and $1,050.00 for any subsequent offense. Note: This penalty is outlined in the City Code of Ordinances Chapter 14, Article V Dangerous Animals. Chapter 18 Buildings and Building Regulations – Article VI. Registration requirements for multi-family buildings (Penalties reset annually on date of required registration) The following civil penalties shall be imposed for the issuance of citations for violations of Section 18-203, Registration required: Failure to register: First month or portion thereof $ 50 Second through sixth month $100 per month or portion thereof Months seven through twelve $200 per month or portion thereof Failure to post registration certificate $100 per occurrence The following civil penalties shall be imposed for the issuance of citations for violations of Section 18-205, Registration requirements: Failure to timely provide updates to required information in: 18-205 Legal owner or owners; 18-205 Business operator; 18-205 Property manager; or 18-205 Emergency per occurrence Chapter 38 Fire Prevention and Protection - Class B or Class C gas leaks A fine of $1,050.00. Note: This penalty is outlined in the City Code of Ordinances Chapter 38, Article II. Fire Prevention Code. Chapter 50 Offenses and Miscellaneous Provisions – Nuisance Parties - Penalties The following are civil violation penalties: A violation of section 50-16(b) Duty to control premises $ 300 A violation of section 50-16(c) Order to cease and disperse 500 A violation of section 50-17(b) Second nuisance party 500 A violation of section 50-17(c) Third or more nuisance party 1,000 Note: These penalties are outlined in the City Code of Ordinances Chapter 50 Offenses and Miscellaneous Provisions, Article I In General. Chapter 50 Offenses and Miscellaneous Provisions – Prohibiting tobacco use in designated public rights of way – Penalty The following civil penalties shall be imposed for the issuance of citations: First offense $ 100.00 Second offense 200.00 Third offense and subsequent offenses 300.00 Note: These penalties are outlined in the City Code of Ordinances Chapter 50, Offenses and Miscellaneous Provisions, Article I In General. Chapter 50 Offenses and Miscellaneous Provisions - Same-Contents Citation A civil penalty of $110.00. Note: This penalty is outlined in the City Code of Ordinances Chapter 50, Article II Citation System of Code Enforcement. Chapter 50 Offenses and Miscellaneous Provisions - Penalty The following civil penalties shall be imposed for the issuance of citations: First citation $ 110.00 Second citation 215.00 Third citation 425.00 Fourth and subsequent citations 850.00 Note: These penalties are outlined in the City Code of Ordinances Chapter 50 Offenses and Miscellaneous Provisions, Article II Citation System of Code Enforcement. ---PAGE BREAK--- CITY DEPARTMENT MISCELLANEOUS FEES AND PENALTIES 5 Updated 10/17/2023 Chapter 50 Offenses and Miscellaneous Provisions - Further violations A $110.00 civil penalty imposed for the first citation, and a civil penalty of $225.00 has been imposed for the second citation. Note: This penalty is outlined in the City Code of Ordinances Chapter 50, Article II Citation System of Code Enforcement. Chapter 50 Offenses and Miscellaneous Provisions - Penalties A civil penalty of not less than $30.00 and not more than $110.00. Note: This penalty is outlined in the City Code of Ordinances Chapter 50, Article III Minors. Chapter 50 Offenses and Miscellaneous Provisions - Discharging firearms A first violation penalty not to exceed $280.00. Second and subsequent violations of this section shall be punishable by a penalty not to exceed $560.00. Note: This penalty is outlined in the City Code of Ordinances Chapter 50, Article IV Weapons and Explosives. Chapter 50 Offenses and Miscellaneous Provisions - Penalty A fine of $1,105.00 for each offense. Note: This penalty is outlined in the City Code of Ordinances Chapter 50, Article V Obscenity. Chapter 50 Offenses and Miscellaneous Provisions - Penalty The following are civil violation penalties: First citation $ 60.00 Second citation 240.00 Third citation 345.00 Fourth and subsequent citations 560.00 Note: These penalties are outlined in the City Code of Ordinances Chapter 50, Offenses and Miscellaneous Provisions, Article VI Operation of Noise-Creating Devices Upon Public Rights-of-Way. Chapter 50 Offenses and Miscellaneous Provisions - Penalties A fine of not more than $525.00 for the first offense, and not more than $$1,050.00 for a second, and no more than $2,100.00 for a third and any subsequent offense. Note: This penalty is outlined in the City Code of Ordinances Chapter 50, Article VII Graffiti Violations. Chapter 50 Offenses and Miscellaneous Provisions - Penalty The following civil penalties shall be imposed for the issuance of citations: First offense $ 100.00 Second offense 200.00 Third offense 300.00 Fourth and subsequent offenses 400.00 Note: These penalties are outlined in the City Code of Ordinances Chapter 50, Offenses and Miscellaneous Provisions, Article X Aggressive Panhandling. Chapter 54 Parks and Recreation - Penalty The following civil penalties shall be imposed for the issuance of citations: First offense $ 100.00 Second offense 200.00 Third and subsequent offense 300.00 Note: These penalties are outlined in the City Code of Ordinances Chapter 54, Section 10 Smoking in Public Parks, Playgrounds, or Recreational Facilities, Chapter 66 Streets and Sidewalks - Utility Pole in Sidewalk – Penalties A violation of this provision of the Code shall be subject to a $1,000 fine in addition to the requirement that the pole be relocated and that any damage done to the sidewalk be repaired. Failure to remove and repair within a 10 day period shall result in an additional fine of $1,000. Further $1,000 fines shall accrue for each subsequent ten day period during which the pole remains and/or the sidewalk is not repaired. Fines for continuing violations beyond the 10 day period may be waived by the Director of Public Works during any period when, in the Director’s opinion, such work is deemed impracticable due to winter weather conditions. Note: These penalties are outlined in the City Code of Ordinances Chapter 66 Streets and Sidewalks, Article I In General. Chapter 71 Above Ground Power, Fiber and Telecommunications – Utility Poles in the Right of Way - Permitting New Poles Utility Pole Application Review Fee, $500 for up to five poles applied for on one application and $100 for each additional pole beyond 5. ---PAGE BREAK--- CITY DEPARTMENT MISCELLANEOUS FEES AND PENALTIES 7 Updated 10/17/2023 After the Fact Application Penalty: $500 for up to five poles applied for on one application and $100 for each additional pole beyond 5. Utility Pole in Sidewalk – Penalties A violation of this provision of the Code shall be subject to a $1,000 fine in addition to the requirement that the pole be relocated and that any damage done to the sidewalk be repaired. Failure to remove and repair within a 10 day period shall result in an additional fine of $1,000. Further $1,000 fines shall accrue for each subsequent ten day period during which the pole remains and/or the sidewalk is not repaired. Replacement Poles and Unsafe Conditions – Penalties Failure to remove replaced poles within 180 days: $100 per day Failure to Correct Unsafe Installation after Required Notice: $100 per day Permit Revocation – Highway and Sidewalk Projects - Penalties Failure to remove poles within 180 days of notice or date agreed to in writing between the Pole owner and the Public Works Director and receipt of notice of permit revocation: $500 per day Note: These penalties are outlined in the City Code of Ordinances Chapter 71 Above Ground Power, Fiber and Telecommunications – Article I Utility Poles in the Right of Way Chapter 71 Above Ground Power, Fiber and Telecommunications – Small Cell Wireless Telecommunications Facilities – Fees and Penalties Facility Application Review Fee, $500 for up to five facilities in a single permit applied for on one application and $100 for each additional facility beyond 5. Other violations of Chapter 71, Article 1 and/or Article 2, not specifically set forth in this policy shall be fined in accordance with Title 30-A M.R.S.A., section 4452.
