LARAMIE CITY COUNCIL PUBLIC HEARING Original Ordinance No. 1874, Manufactured Home, Mobile Home, Rec Vehicle Park & Campground May 28, 2013 Public Hearing was called to order by Mayor Paulekas at 6:20 p.m. City Council present: Vicki Henry, Jayne Pearce, Roger McKinley, Lee Kempert, Joe Vitale, Klaus Hanson, Joe Shumway, Paul Weaver, and Dave Paulekas. Absent: None. The City Clerk read the notice: THE LARAMIE CITY COUNCIL WILL MEET AT 6:00 P.M. ON TUESDAY, MAY 28, 2013, IN THE CITY COUNCIL CHAMBERS, LARAMIE CITY HALL, 406 IVINSON STREET, LARAMIE, WY, TO TAKE PUBLIC COMMENTS OR PROTESTS ON PROPOSED ORDINANCE 1874. THE REQUEST IS MADE BY AND ON BEHALF OF THE CITY OF LARAMIE. THE PROPOSAL WOULD AMEND THE FOLLOWING CHAPTERS OF THE LARAMIE MUNICIPAL CODE: LMC 15.10, 15.12, 15.14, 15.24, 15.22 AND 15.28 FOR THE PURPOSES OF AMENDING THE MANUFACTURED HOME, MOBILE HOME, TRAVEL TRAILER PARK, RECREATIONAL VEHICLE PARK AND CAMPGROUND LICENSING REQUIREMENTS. ANYONE WISHING TO BE HEARD SHOULD BE PRESENT, OR MAY BE REPRESENTED BY HIS OR HER AGENT AT THE MEETING. Mayor Paulekas asked if there were any public comments. Jennifer Hanft, Attorney representing 7 Acre Mobile Home Park, spoke against the ordinance, stating there were constitutional issues with the proposal; it would restrict development and growth in the City; and a racially discriminatory impact of the ordinance. She asserted that the 5th Amendment provides “the Government, nor shall private property be taken for public use without just compensation”. The proposal requires that a park be 20 acres, thus denying her client use of their property, 7 acres, currently being used as a trailer park, and this would be an unlawful taking. Also, all trailers that are 14 feet wide would have to be removed, there is 16 X 36 foot or larger restriction of trailers, with no grandfather clause in the ordinance. The ordinance would be a enormous expense as it requires a six foot block wall to face arterials and above exposure, with 2 inch in diameter trees planted intermittently in front of the wall; a required 40 foot inset; space required for each trailer is 600 sq. ft., which makes most trailer parks non-compliant as the trailers are parked too close together; a patio area for each trailer that is either concrete or redwood; and additional parking. Moving infrastructure in the parks to comply with the ordinance spacing and requirements would be cost prohibitive. Mobile homes provide affordable housing, and there is a disproportionate number of Hispanics in this community that reside in the mobile home parks. Mayor Paulekas related that the standards for this ordinance were for new parks, and not for existing parks. Charles Bloom, Senior Planner, explained that 16 feet width is the minimum width that is HUD compliant. Ross Gilbert, student at University of Wyoming, stated he and his wife (Melissa) had just purchased a pre-1976 mobile home 2 years ago; it was purchased as an investment, to be sold when they had completed studying with UW; and he strongly encouraged amending the law. He queried how the inspections were to be done, specifically concerning skirting. Bloom related that skirting is required for park licensing renewal, that each unit be skirted. This amendment would remove the license criteria, the requirement for each individual unit is required just for the use of the unit. Doris Manfull, Sunny Meadows Owner, requested that the 180 day limit allowing a Recreational Vehicle to be in a trailer park be eliminated, and to allow RVs to be put in Trailer Parks. ---PAGE BREAK--- LARAMIE CITY COUNCIL PUBLIC HEARING Original Ordinance No. 1874, Manufactured Home, Mobile Home, Rec Vehicle Park & Campground May 28, 2013 Mark Redell, owner of several mobile homes, questioned about what would be grandfathered in the ordinance. He would like a goal of keeping the parks attractive, and a half empty park would not look good. He would like to see more modern mobile homes in place. Melissa Gilbert, owner, requested that pre-1976 mobile homes be grandfathered in. Doris Manfull spoke again regarding the costs involved with running a mobile home park. Jennifer Hanft spoke again expressing concern about how this ordinance would be implemented. She recommended an implemental enforcement on violations such as skirting that had not been enforced, going from a warning ticket, then given a period of time, escalate to fines, to give people a chance to make the required improvements. Clarification about what is going to be grandfathered in would be completely beneficial.
