Laramie Planning Commission April 8, 2013 Page 1 of 4 MINUTES Laramie Planning Commission Monday, April 8, 2013 at 4:30 PM City Council Chambers, City Hall 406 Ivinson, Laramie, WY The Planning Commission meetings are open to the public. Requests from person with disabilities must be made to the Community Development Department 48 hours in advance of the meeting. 1. CALL TO ORDER/ ROLL CALL Meeting convened at 4:30 PM Members present: Bob Boysen, Nadia Kaliszewski, Angela King (Vice-Chair), Jim McGrath, Anthony Mendoza Members absent: Randy Vickers, Kaye Willis There was a quorum present at all times. Council Liaison: Joe Vitale (present) Staff Present: Charles Bloom, Randy Hunt, Cody Jennings, Larry Ketcham, Karen Tangeman, Derek Teini, Kathleen Wickersham 2. APPROVAL OF AGENDA AND MINUTES 2-A. Changes and Approval of Agenda MOTION BY KALISZEWSKI, seconded by McGrath, to approve the Agenda for the April 8, 2013 Planning Commission meeting Aye: 5 Nay: 0 Motion carried. 2-B. No Minutes 3. CITIZEN COMMENTS - Non-Agenda Related Topics – No Action Can Be Taken No citizen comments 4. PLANNING COMMISSION AND STAFF REPORTS AND COMMENTS Hunt informed the Commission that near-future steps for Cirrus Sky include: Complete a Traffic Study; Stake Holders meeting; Drainage study for project and development south of project; and Approval of the Preliminary Plat. Staff anticipates that the University of Wyoming will submit plans for the Enzi STEM Building soon. Recently a series of Major Street Plan amendments were approved by the Urban Systems Advisory Committee regarding North Laramie traffic flow and traffic in the Bill Nye Avenue and Turner Tract area. DISCLOSURES Boysen requested that he recuse himself from agenda item 6-C. Spring Creek Village- Preliminary Plat. 6. CURRENT PLANNING PROJECTS OLD BUSINESS: 6-A. FP-13-01 Silver Sage Estates, 1st Filing Final Plat Bloom addressed the Commission and requested the Final Plat be postponed until May 13, 2013. MOTION BY MENDOZA, seconded by Kaliszewski, to postpone action on the final plat and continue the public hearing on FP-13-01 to May 13, 2013. Aye: 5 Nay: 0 Motion carried. 6-B. FP-12-04 Indian Ridge, 1ST Addition Final Plat Teini requested the Indian Ridge, 1st Addition Final Plat be postponed until the June 10, 2013 meeting, to allow staff time to review additional material that were recently submitted. City Engineer, Ketcham informed the Commission that the Department of Environmental Quality (DEQ) approved the injection well; however approval requires the signature of the owner. In this case the property owner is the City of Laramie, who will not sign. On March 6th, the City met with the applicant to discuss and explore options. The City and applicant plan to meet again on April 10th. Ketcham provided background information and answered questions. Harold Hollingsworth of Hollingsworth Associates Inc. addressed the Commission. Hollingsworth, a geological engineer, was hired as a consultant by the City to review Indian Ridge’s proposed storm water injection well and provide his findings, which he shared and explained at the meeting. The applicant, Grant requested the project be postponed only until the May 13, 2013 meeting. The following citizens spoke on this matter: Laurel 1358 Indian Hills Drive, Laramie Greg Brown, 1156 Banock Drive, Laramie Chris Ewing, 1456 Dakota Drive, Laramie Rebecca Riley, 1063 Arapaho Drive, Laramie MOTION BY KALISZEWSKI, seconded by Boysen, to postpone action on the final plat and continue the public hearing on FP-12-04 to June 10, 2013. PP-12-06 Spring Creek Village – Preliminary Plat Bloom provided the staff report. Fall Creek Development, LLC requested a preliminary plat proposing 8 lots within a 31.12 acre parent tract, for the purpose of constructing a mini-storage complex and future commercial or residential development. The proposal is generally located west of 9th Street between future Bill Nye Avenue extension and the Spring Creek Channel. Kelly Hafner, representing the applicant, addressed the Commission to provided additional information and answer questions. MOTION BY MCGRATH, seconded by Mendoza, to recommend approval to the Laramie City Council of PP-12-06 Spring Creek Village Preliminary Plat, based on findings of fact and conclusions of law and subject to staff’s recommended conditions. Aye: 4 Nay: 0 Motion carried. Commissioner Boysen returned to the room and the meeting. 6-D. CUP-13-03 312 South 7th Street – Family Child Care Center Jennings requested a postponement until April 22, 2013 for the Conditional Use Permit of a Family Child Care Center located at 312 South 7th Street, to allow sufficient time for posting the property per UDC requirement. MOTION BY MENDOZA, seconded by Boysen, to postpone and continue the public hearing until April 22, 2013, on a Conditional Use Permit for operation of a Family Child Care Center not to exceed fifteen (15) children located at 312 S. 7th Street, based on findings of fact, to allow sufficient time for posting the property per UDC requirement. Aye: 5 Nay: 0 Motion carried. 6-E. CUP-13-04 618 Ord Street – Type 2 Child Care Home Jennings addressed the Commission and requested a postponement until April 22, 2013 for the Condition Use Permit of a Type 2 Child Care Home located at 618 Ord Street, to allow sufficient time for posting the property per UDC requirement. MOTION BY MENDOZA, seconded by McGrath, to postpone and continue the public hearing until April 22, 2013, on a Conditional Use Permit for operation of a Type 2 Child Care Home not to exceed ten (10) children located at 618 Ord Street, based on findings of fact and to allow time for the applicant to place notice on the property. Aye: 5 Nay: 0 Motion carried. 6-F. Tree Area Overlay District Update Teini presented an update on the Tree Area Overly (TOA) District. Staff recommended that Commissioners review the presentation, regulations and other general information regarding this ---PAGE BREAK--- Laramie Planning Commission April 8, 2013 Page 4 of 4 District that has been made available on the Community Development Department’s page on the City’s website regarding the TAO District. 7.
