Requests from person with disabilities must be made to the Community Development Department 48 hours in advance of the meeting. 1. CALL TO ORDER/ ROLL CALL Meeting convened at 4:31 PM Members present: Bob Boysen, Angela DeWolf King, Nadia Kaliszewski (arrived at 4:33 PM), Jim McGrath, Anthony Mendoza, Randy Vickers (arrived at 4:56 PM) and Kaye Willis (Chair) Members absent: None There was a quorum present at all times. Council Liaison: Joe Vitale (present) Staff Present: Charles Bloom, and Kathleen Wickersham 2. APPROVAL OF AGENDA AND MINUTES 2-A. Changes and Approval of Agenda Agenda approved as written. 2-B. Monday, June 24, 2013 Planning Commission Meeting Minutes MOTION BY BOYSEN, seconded by Mendoza, to approve the Minutes from the June 24, 2013 Planning Commission meeting, as written. Monday, July 22, 2013 Planning Commission Meeting Minutes MOTION BY BOYSEN, seconded by Mendoza, to approve the Minutes from the July 22, 2013 Planning Commission meeting, as written. Monday, July 08, 2013 Planning Commission Meeting Minutes MOTION BY BOYSEN, seconded by Mendoza, to approve the Minutes from the July 08, 2013 Planning Commission meeting, as written. CITIZEN COMMENTS - Non-Agenda Related Topics – No Action Can Be Taken No citizen comments 4. PLANNING COMMISSION AND STAFF REPORTS AND COMMENTS 4-A. Report (FYI) A copy of the Community Development Department’s Report was provided to each Commissioner in their agenda packet. Bloom informed the Commission that the City Council would have a work session on The Tree Area Overlay on Tuesday, August 27th at 6 PM in the Council Chambers. Staff has been working on a Request for Proposals (RFP) for the Housing Study. McGrath requested that Laramie Economic Development Corporation (LEDC) and citizens assist the City staff in updating the Use Table in the UDC. The Use Table will reflect the current uses and updated uses of the future. Once the updates are drafted they would come before the Planning Commission and City Council. 5. DISCLOSURES No disclosures 6. CURRENT PLANNING PROJECTS OLD BUSINESS: 6-A. CUP-13-08 1532 Court, Retirement Home Bloom provided the staff report. The applicant, Cornerstone Associates, LLC, requested a conditional use permit to develop a retirement home (senior housing facility) at 1532 Court. Cornerstone Associates, LLC’s representative, Bobbi Lucas, provided the Commissioners with pictures of a similar facility that Cornerstone built and answered questions. MOTION BY BOYSEN, seconded by Vickers, to approve a Conditional Use Permit to construct a retirement home with private porches at 1532 Court zoned B1/APO/TTO and grant the Alternative Equivalent Compliance request for LMC 15.14.080.D.3.b; based on findings of fact and conclusions of law and subject to all of staff’s recommended conditions. Aye: 6 Nay: 1 Motion carried. NEW BUSINESS: 6-B. CUP-13-10 1523 Steele Street, Family Child Care Home Bloom informed the Commission that the applicants, Kassidy Rathburn and Tiffnee Lemons have requested a conditional use permit to establish a family child care center at 1523 Steele Street. The following citizen spoke on this matter: Joyce Hofferber, 1605 Steele Street, Laramie The applicants were present and addressed the Commission to provide additional information. ---PAGE BREAK--- Laramie Planning Commission August 26, 2013 Page 3 of 4 MOTION BY KALISZEWSKI, seconded by Mendoza, to deny a Conditional Use Permit for operation of a Family Child Care Center in a residential structure located at 1523 Steele Street and zoned R1 (Single-Family Residential) District, based on findings of fact and conclusions of law and subject to all of staff’s recommended conditions. Aye: 1 Nay: 6 Motion failed. MOTION BY KING, seconded by Boysen, to approve a Conditional Use Permit for operation of a Family Child Care Center in a residential structure located at 1523 Steele Street and zoned R1 (Single-Family Residential) District, based on findings of fact and conclusions of law and subject to all of staff’s recommended conditions. AMENDMEMENT: MOTION BY MCGRATH, seconded by Boysen to add two additional conditions: 7. The Family Child Care Center shall provide three off street parking spaces in the alley for resident/employee. 8. Hours of operation for the Family Child Care Center shall be Monday through Friday, 7:00 AM to 6:00 PM. Aye: 6 Nay: 1 Motion carried. ORIGINAL MOTION: Aye: 6 Nay: 1 Motion carried. 6-C. CUP-13-11 2002 19th Street, Type 2 Child Care Home Bloom provided the background information regarding the project. The applicant, Misty Siebert has requested a conditional use permit to establish a Type 2 Child Care Home located at 2002 South 19th Street. The applicant provided supplementary information. MOTION BY KING, seconded by Mendoza, to approve a Conditional Use Permit for operation of a Type 2 Child Care home in a single-family residence located at 2002 South 19th Street and zoned R1 (Single-Family Residential) District, based on findings of fact and conclusions of law and subject to all of staff’s recommended conditions.
