Laramie Planning Commission April 22, 2013 Page 1 of 4 MINUTES Laramie Planning Commission Monday, April 22, 2013 at 4:30 PM City Council Chambers, City Hall 406 Ivinson, Laramie, WY The Planning Commission meetings are open to the public. Requests from person with disabilities must be made to the Community Development Department 48 hours in advance of the meeting. 1. CALL TO ORDER/ ROLL CALL Meeting convened at 4:30 PM Members present: Bob Boysen, Jim McGrath, Anthony Mendoza and Kaye Willis (Chair) Members absent: Angela DeWolf King, Nadia Kaliszewski, Randy Vickers, There was a quorum present at all times. Council Liaison: Joe Vitale (absent) Staff Present: Charles Bloom, Randy Hunt, Cody Jennings, Larry Ketcham, Karen Tangeman and Kathleen Wickersham 2. APPROVAL OF AGENDA AND MINUTES 2-A. Changes and Approval of Agenda Agenda was approved as written. 2-B. Monday, March 25, 2013 Planning Commission Meeting Minutes MOTION BY MENDOZA, seconded by Boysen, to approve the Minutes from the March 25, 2013 Planning Commission meeting, as written. Aye: 4 Nay: 0 Motion carried. 3. CITIZEN COMMENTS - Non-Agenda Related Topics – No Action Can Be Taken No citizen comments 4. PLANNING COMMISSION AND STAFF REPORTS AND COMMENTS 4-A. Report (FYI) A copy of the Community Development Department’s Report was provided to each Commissioner in their agenda packet. Hunt provided the Commissioners a handout on City Council Goals for 20013-2014. It was noted that many of the projects involved the Community Development Department. 5. DISCLOSURES No disclosures 6. CUP-13-03 312 South 7th Street – Family Child Care Center Jennings presented the staff report, stating that the applicant, Ginger Davis & Yaser Abdelkader requested a Conditional Use Permit to establishment a Family Child Care Center not to exceed fifteen (15) children at the location of 312 South 7th Street. Ginger Davis was present and addressed the Commission to answer questions. MOTION BY BOYSEN, seconded by Mendoza, to approve a Conditional Use Permit for operation of a Family Child Care Center not to exceed fifteen (15) children located at 312 S. 17th Street, based on findings of fact and conclusions of law and subject to all staff’s recommended conditions. Aye: 4 Nay: 0 Motion carried. 6-B. CUP-13-04 618 Ord Street – Type 2 Child Care Home Jennings, provided the staff report, noting that the Applicant, Sarah Sushma Blake requested a Conditional Use permit to establish a Type 2 Child Home not to exceed ten (10) children located at 618 Ord Street. The applicant, Sarah Sushma Blake was available and willing to answer questions. MOTION BY MENDOZA, seconded by McGrath, to approve a Conditional Use Permit for operation of a Type 2 Child Care Home not to exceed ten (10) children located at 618 Ord Street, based on findings of fact and conclusions of law and subject to all staff’s recommended conditions, with staff’s recommendation #4 being amended to read: “The Type 2 Child Care Home shall have 10 or fewer child on-site, excluding owner’s own children.” Aye: 4 Nay: 0 Motion carried. 6-C. WS-13-02 Schedule Work Session for May 6th: Turner Tract Plan Update Preliminary Findings MOTION BY MCGRATH, seconded by Mendoza, to schedule a Turner Tract Plan Update Work Session for May 6, 2013 in the City Council Chambers of City Hall, to begin at 4:30 PM. Aye: 4 Nay: 0 Motion carried. NEW BUSINESS: 6-D. CPA-13-01 Northeast of the Intersection of Vista Drive and Bobolink Lane: Amendment to Future Land Use Plan Bloom addressed the Commission to provide the staff report. The applicant, Chas Johnson of Laramie Rockworth Apartments requested a Land Use Plan Amendment from “Estate” to “Auto- Urban Multifamily” for an area approximately 6.3 acres in size. The project is generally located northeast of the intersection of Vista Drive and Bobolink Lane. ---PAGE BREAK--- Laramie Planning Commission April 22, 2013 Page 3 of 4 The applicant addressed the Commission to provide additional information and answer questions. The following citizens spoke on this matter: Ken Hall, 4616 Bobolink Lane, Laramie Richard Weron, 4512 Bobolink Lane, Laramie Joe Moreno, Vista Drive, Laramie Marile Christensen, 2003 Spring Creek Drive, Laramie MOTION BY BOYSEN, seconded by Mendoza, to approve Planning Commission Resolution 2013-01, granting a request to amend Future Land Use Map (Map 3.2) of the Comprehensive Plan for the property described in the Resolution, generally located at the northeast of the intersection of Vista Drive and Bobolink Lane, by changing the Future Land Use Designation from the “Estate” category to the “Auto-Urban Multifamily” category, based on findings of fact and conclusions of law, and to forward the item to City Council for certification. Aye: 3 Nay: 1 Motion failed. [Note: Per W.S. 15-1-505, adoption of a Comprehensive Plan or amendments thereto requires a majority affirmative vote of the full Commission membership – i.e., 4 out of 7. LONG RANGE PLANNING PROJECTS No items 8. VARIANCES (sitting as Board of Adjustment) No items 9. Planning Commission adjourned at 6:30 PM 10. CONVENE AS THE NUISANCE BOARD OF APPEALS 10-A. Nuisance Overview Brian Forster, Code Enforcement Inspector, provided an overview of the Nuisance Board of Appeal process. 11. ADJOURN AS THE NUISANCE BOARD OF APPEALS MOTION BY MCGRATH, seconded by Mendoza, to adjourn as the Nuisance Board of Appeals. Aye: 4 Nay: 0 Motion carried.
