Requests from person with disabilities must be made to the Community Development Department 48 hours in advance of the meeting. 1. CALL TO ORDER AS THE BOARD OF ADJUSTMENT Meeting convened at 4:36 PM Members present: Bob Boysen, Nadia Kaliszewski, Anthony Mendoza and Kaye Willis (Chair) Members absent: Angela DeWolf King, Jim McGrath, Randy Vickers There was a quorum present at all times. Monday, October 14, 2013 Planning Commission Meeting Minutes MOTION BY KALISZEWSKI, seconded by Mendoza, to approve the Minutes from the October 14, 2013 Planning Commission meeting, as written. Monday, October 28, 2013 Planning Commission Meeting Minutes MOTION BY MENDOZA, seconded by Boysen, to approve the Minutes from the October 28, 2013 Planning Commission meeting, as written. PLANNING COMMISSION AND STAFF REPORTS AND COMMENTS A copy of the Community Development Department’s Report was provided to each Commissioner in their agenda packet. City Council approved a grant for the cleanup of the property. City has placed a request for bid (RFB) on the drainage portion of the Indian Ridge Project. The intent was to resolve drainage complexities in the main Indian Ridge Project and allow for some other drainage problems in the area to be fixed as well. Indian Ridge 2nd Plat is expected to convey the Southwest part of the project to the City and trade City property on Garfield near the Ice & Event Center for the church. Enzi STEM Building – building permits were issued last week. Part of Lewis Street will be vacated in connection with the project. Commissioners were reminded that there will be no further Planning Commission meetings in 2013. 5. DISCLOSURES Commissioner Mendoza disclosed that he rents from M3 Enterprises, LLC (agenda item 8-A.) 6. CURRENT PLANNING PROJECTS OLD BUSINESS: No items NEW BUSINESS: 6-A. Approval of Submittal Calendars Wickersham explained to the Commissioners that the UDC requires the Planning Commission to adopt their annual schedule of meetings (UDC §15.04.030.D, p2). In addition to the Commission’s meeting schedule, they were also provided the Departments’ calendars for each type of application to show the deadlines and meeting schedules and how they fit into the overall scheme. It was also noted that May only has one Planning Commission meeting. MOTION BY KALISZEWSKI, seconded by Mendoza, to designate the City of Laramie Planning Commission’s meeting dates as shown on the ‘Laramie Planning Commission – Meeting Calendar for 2014’, per UDC Section 15.04.030.D. Aye: 4 Nay: 0 Motion carried. 6-B. CUP-13-14 265 North Lincoln Street - Type 2 Child Care Home Gonzales informed the Commission that the applicant, CheyAnne Nielson requested a postponement on her Condition Use Permit request. MOTION BY KALISZEWSKI, seconded by Mendoza, to postpone action and continue the public hearing on CUP-13-14 to January 13, 2014, based on findings of fact and conclusions of law, to allow the applicant time to review and possibly change her request. CUP-13-15 2023 Spring Creek Drive - Type 2 Child Care Home Gonzales reviewed the staff report with the Commission. The applicant, Brenna Randall, requested a conditional use permit for operation of a Type 2 Child Care Home at 2023 Spring Creek Drive. Ms. Randall was present and answered the Commissioner’s questions. MOTION BY BOYSEN, seconded by Mendoza, to approve a Conditional Use Permit for operation of a Type 2 Child Care Home not to exceed ten (10) children located at 2023 Spring Creek Drive zoned R1 (Single-Family Residential) District based on findings of fact and conclusions of law and subject to all staff’s recommended conditions. Aye: 4 Nay: 0 Motion carried. 6-D. PP-13-05 Paintbrush Addition - Preliminary Plat Assistant Planner Gonzales provided the staff report. Rawstone Development, Inc., the applicant has requested a preliminary plat, proposing 34 lots within two areas approximately 8 and 2 acres in size, for construction of future single-family homes. Area 1 is generally located at the future intersection of Dillon Street and Battle Street. Area 2 is generally located north of Reynolds Street between Bath Avenue and 28th Street. Gonzales indicated that subsequent to the staff report, staff now recommends that Condition 4B be excluded from the conditions due to a conflict with UDC. Warren Greaser and Paul Greaser of Rawstone Development, Inc., addressed the Commission to provide additional information and answer questions. MOTION BY MENDOZA, seconded by Kaliszewski, to recommend approval to the Laramie City Council of PP-13-05 Paintbrush Addition Preliminary Plat, based on findings of fact and conclusions of law and subject to staff’s recommended conditions, excluding condition 4B. Aye: 4 Nay: 0 Motion carried. 7. LONG RANGE PLANNING PROJECTS No items 8. VARIANCES (sitting as Board of Adjustment) (Swearing in of Witnesses) 8-A. VAR-13-05 3905 Grand Avenue Senior Planner, Bloom, stated that M3 Enterprises, LLC has asked for a Variance from LMC 15.08.040.A.7 “Vulnerable features that require a setback”. The purpose of the Variance request is to construct a Professional/Medical Office building that will encroach into a 100 ft setback from a drainage channel, located on Lot 5, Block 3 of Upland Heights Addition. David Milam and Dylan Milam of M3 Enterprises, LLC, spoke to the Commissioners regarding the request and answered questions. MOTION BY BOYSEN, seconded by Mendoza, to approve the requested variance from Laramie Municipal Code 15.08.040.A.7 “Vulnerable features that require a setback”, to allow construction of a Professional/Medical Office building with no setback from an on-site drainage ---PAGE BREAK--- Laramie Planning Commission December 9, 2013 Page 4 of 4 channel determined to be a vulnerable feature in the APO (Aquifer Protection Overlay) Zone, based on findings of fact and conclusions of law and subject to staff’s recommended conditions, and including one additional condition: The Design Review Application shall be submitted within twelve (12) months of this Variance being approved.
