CITY OF LAFAYETTE RESOLUTION NO. 2013-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, PERTAINING TO THE NUMBER OF NEW DWELLING UNITS THAT MAY BE BUILT IN CALENDAR YEAR 2013, AND THE ANTICIPATED NUMBER OF NEW DWELLING UNITS TO BE BUILT IN CALENDAR YEAR 2014 WHEREAS, Sections 6.10 through 6.15 of the City of Lafayette Home Rule Charter provides for a system of Residential Growth Management that limits the number of new dwelling units that may be constructed within the City; and WHEREAS, Section 6.10 of the City of Lafayette Home Rule Charter was significantly amended by a vote of the people in the November 6, 2012, election to require City Council to allocate the number of new dwelling unit permits over a six year period, to adopt an ordinance pertaining to the criteria to be used in such allocation, and to exempt from the Residential Growth Management Program certain properties, including those who had received priority prior to November 6, 2012; and WHEREAS, Section 6.10 of the City of Lafayette Home Rule Charter, and Section 30-271 of the Lafayette Code of Ordinances requires City Council to annual ly determine the maximum number of new dwelling units to be built in the calendar yearunder the provisions of the Residential Growth Management Program, and to anticipate the number to be built in the next calendar year; and WHEREAS, the Lafayette City Council is in the process of adopting substantial amendments to Article XI of Chapter 30 of the Lafayette Code of Ordinances (“Growth Management”), as required by the November 6, 2012, Charter Amendment; and WHEREAS, the Lafayette City Council wishes to comply with the provisions of the Charter and the Code of Ordinances that require an annual determination of permits to be issued for new dwelling units, but wishes to recognize that substantial amendments to the Code of Ordinances pertaining to the allocation of new dwelling unit building permits will be addressed and adopted in the immediate future, as required by the Charter. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lafayette, Colorado as follows: 1. Pursuant to Section 6.10 of the City of Lafayette Home Rule Charter, and Section 30-271 of the Lafayette Code of Ordinances, City Council hereby determines that the number of new dwelling units to be built in calendar year 2013 that are subject to the Residential Growth Management Restrictions of the Lafayette Home Rule Charter shall be zero until such time as the Lafayette City Council amends Article XI, of Chapter ---PAGE BREAK--- City of Lafayette Resolution 2013-01 Page 2 of 2 30 of the Lafayette Code of Ordinances to address the allocation of permits for new residential buildings over the period of time from January 1, 2013 through January 1, 2019. Upon adoption of such an ordinance, City Council shall amend this resolution to determine the number of new dwelling units that may be built in the remainder of the calendar year 2013 pursuant to the provisions of such amended ordinance. 2. Subject to modification upon the adoption of amendments to Article XI, Chapter 30 of the Lafayette Code of Ordinances, City Council anticipates that the number of new dwelling units subject to the Residential Growth Management Restrictions of the City of Lafayette Home Rule Charter that may be built in calendar year 2014 will be 200 units. 3. This resolution and the provisions relating to the number of new dwelling units that may be built in calendar years 2013 and 2014 shall have no effect upon, or otherwise limit the number of new dwelling units that may be constructed in the City of Lafayette to the extent that such dwelling units are exempted from the Residential Growth Management provisions of Section 6.10 of the Lafayette Home Rule Charter RESOLVED AND PASSED THIS 7TH DAY OF JANUARY, 2013.
