AGREEMENT COMES NOW, the City of Lafayette, a Municipal Corporation, hereinafter called "CITY," and an individual who has submitted a petition for annexation hereinafter called the '"PETITIONER" and in consideration of the mutual promises, covenants and agreements contained herein and for other good and valuable consideration agree as follows: 1. That as a part of the consideration for annexation by the City, the Petitioner agrees to pay all of the costs of legal advertising, title search costs, ownership plat costs and engineering and surveying costs which arise out of his submission of the petition for annexation. 2. It is understood that this cost cannot accurately be determined prior to the time that it is incurred by the petitioner agrees that upon submission of a statement from the City of Lafayette and by and through its City Administrator, he will pay the cost of such legal advertising and if he fails to do so, the City Council shall vacate any proceedings which may have been had regarding the property which he has submitted for annexation. 3. It is understood that in an annexation involving more than one landowner, the costs reimbursed to the City may be borne proportionately by the petitioners. 4. That the parties hereto signify by their signatures affixed below that they have had an opportunity to read this agreement, have each received a copy of it and have had the opportunity to consult legal counsel of their own choosing prior to signing.
