1 STATEMENT OF UNDERSTANDING WHEREAS, the undersigned person(s)/entity has heretofore submitted to the City of Lafayette, Colorado a petition for the annexation of certain real property to the territorial limits of the City of Lafayette, Colorado, and WHEREAS, a description of the real property that the undersigned person(s)/entity desires to be annexed to the territorial limits of the City of Lafayette, Colorado is attached hereto, marked Exhibit and made a part hereof, and WHEREAS, all or a portion of the aforementioned property is located within the Fire Protection District, and WHEREAS, upon the completion of the aforementioned annexation, the real property described on attached Exhibit will receive fire and ambulance service from the City of Lafayette, Colorado Volunteer Fire Department, and WHEREAS, until the real property described on attached Exhibit is withdrawn from the Fire Protection District, said property will continue to be taxed by the aforementioned fire protection district pursuant to state statutes. NOW, THEREFORE, it is the understanding of the undersigned as follows: 1. That upon the completion of the aforementioned annexation, the real property described in attached Exhibit will receive fire and ambulance service from the City of Lafayette, Colorado Volunteer Fire Department. 2. That it shall be the responsibility of the undersigned to withdraw the property described on attached Exhibit from said fire district at the sole cost of the undersigned. 3. That should the undersigned fail to withdraw the above-described property from the above-mentioned fire district within six months of annexation, no action by the City of Lafayette, Colorado will be taken to remove the property described in attached Exhibit from said fire district. Furthermore, the City of Lafayette, Colorado will not be responsible for any double taxation that will result from the failure to withdraw the property from the above- mentioned fire district. 4. That the written Statement of Understanding shall be recorded in the office of the Boulder County Clerk and Recorder and shall be binding upon the undersigned and any and all assigns and/or purchasers of the above-described real property. ---PAGE BREAK--- 2 Dated this day of 20__.
