Also, create an Urban Reserve designation that will apply to areas outside the City’s UGA, for planning growth during the 20‐40 year time horizon. The City may approve Comprehensive Plan Amendments and area‐wide zone map amendments if it finds that (analysis is italicized): 1. The proposed amendment bears a substantial relationship to the public health, safety, welfare, and protection of the environment; The proposed amendment bears a substantial relationship to the public health, safety, welfare, and protection of the environment. The area proposed to be included in the UGA is part of the Empire Lakeside Estates subdivision. The majority of the subdivision was included in the City’s UGA, however the UGA boundary followed the centerline of S. Kingwood St. and excludes 8 parcels of the subdivision. The subdivision is currently served by Kennewick Irrigation District for potable water. The water is sold to KID from the City and then is distributed to the residents. KID would like to turn over the operation of the lines to the City, but State statute prevents the City from providing water to areas outside of the UGA. The inclusion of these lots will ensure that these residents will continue to receive water if/when the lines are transferred to the City. The addition of an Urban Reserve designation allows the City to plan beyond its 20 year boundary. Currently the City’s water and sewer comprehensive plans focus on a 20 year to 50 year service areas. The current service areas extend beyond the City’s UGA and have for a number of years. The Urban Reserve designation will allow for more comprehensive planning for the City’s growth within the 20 to 40 year horizon. 2. The proposed amendment is consistent with the requirements of Chapter 36.70A RCW and with the portion of the City’s adopted comprehensive plan not affected by the amendment; This amendment is consistent with the requirements of Chapter 36.70A RCW and with the portion of the City’s adopted comprehensive plan not affected by the amendment. 3. The proposed amendment corrects an obvious mapping error; This request does not correct a mapping error. 4. The proposed amendment addresses an identified deficiency in the Comprehensive Plan. The request addresses an identified deficiency in the Comprehensive Plan relating to the City’s lack of Industrial land to meet 20 year goals and population projections. KMC 4.12.110(8): Additional Factors. The City must also consider the following factors prior to approving Comprehensive Plan Amendments: 1. The effect upon the physical environment; There is no immediate effect on the environment. The area proposed to be included in the UGA is developed. The area proposed for Urban Reserve will not be included in the City’s UGA until a future date when needed, with the exception of that area that is pending a decision with Benton County. ---PAGE BREAK--- Staff Report CPA 13-09 2. The effect on open space and natural features including, but not limited to topography, streams, rivers, and lakes; There is no immediate effect on open space or natural features. The Urban Reserve area will not be included in the City’s UGA for a number of years. 3. The compatibility with and impact on adjacent land uses and surrounding neighborhoods; The area that is proposed to be included in the City’s UGA will not affect the surrounding neighborhood. The areas that are proposed to be removed are being proposed due to the existing development patterns. Current development in the areas proposed to be removed is such that capacities to accommodate future growth are limited. Removal will not impact adjacent land uses or surrounding neighborhoods. 4. The adequacy of, and impact on community facilities, including utilities, roads, public transportation, parks, recreation, and schools; The area that is proposed to be included in the City’s UGA is already receiving City water via KID. Sewer in the area and could be extended if needed. The area is built out so impacts on community facilities will be nonexistent unless they decide to extend sewer through an Local Improvement District. The area proposed for Urban Reserve will not impact community facilities until such time that it is included in the City’s UGA. The areas proposed to be removed are not currently receiving services, therefore no impact is expected. 5. The quantity and location of land planned for the proposed land use type and density and the demand for such land The land that is proposed to be included in the UGA will be designated Residential Low Density. The total land area to be included is approximately 4 acres covering 8 lots and abutting right of way. Inclusion of this land into the City’s UGA will have little, if any, effect on density in the area as the neighborhood is primarily in the City Limits and these 8 lots are part of the subdivision. The area proposed for removal is approximately 410 acres. This area is designated Low Density Residential. Removal of these areas will likely lead to an increase in density throughout the UGA. The areas proposed for removal have haphazard residential development throughout. There are many lots of sizes between one and five acres, which are difficult to redevelop to gain capacity for urban densities without consolidating several lots from several property owners. Removal will focus development in other areas in the city where more urban development is taking place. The area proposed for Urban Reserve is proposed to be designated Industrial. Approximately 3% of the City’s total land area (including the UGA) is designated for Industrial development. The City currently has an application pending with Benton County to expand the UGA to include 1,250 acres for Industrial development. This area will also be designated Urban Reserve until it is included in the City’s UGA. The area for inclusion in the City’s Urban Reserve Area is a total of 2,647 acres. 6. The current and projected project density in the area The areas proposed for removal are large parcels of very low density residential development. It is expected, based on past development patterns in this area that there will be limited growth ---PAGE BREAK--- Staff Report CPA 13-09 occurring in this area over the next 20 years. Due to development patterns and lot configurations the capacity to accommodate future growth is minimal. The proposed area to be added to the UGA contains low density residential development, is built out and will not likely experience any more growth. The area proposed to be designated Urban Reserve is anticipated for industrial development, therefore, no increase in residential density is expected as no development or inclusion in the UGA is expected for a number of years. 7. The effect, if any upon other aspects of the Comprehensive Plan The proposal will reduce the amount of Low Density Residential designated land in the City’s UGA by approximately 410 acres, however there is an abundance of Low Density Residential land already in the UGA and enough residential land, in general, to accommodate 20 years of population growth. Approximately 1,400 acres is proposed to be designated Urban Reserve. This land will likely be designated for Industrial use. The area to be added will have a minimal, if any, effect on the Comprehensive Plan. PUBLIC COMMENT Staff has received no public comment concerning the proposal to date. AGENCY COMMENTS Staff has received no agency comment concerning the proposal to date. FINDINGS 1. The request is proposed by the City of Kennewick. 2. The request is to identify areas of the City’s UGA to amend and to include and Urban Reserve Area designation. 3. The application was received on May 1, 2012 and was routed for review to various City Departments and other local, state and federal agencies for comment on June 19, 2012. 4. The areas proposed to be removed from the UGA are designated Low Density Residential. The area proposed to be added to the UGA will be designated Low Density Residential. The area proposed for Urban Reserve is proposed to be designated Industrial. 5. A Determination of Non‐Significance (ED 13‐35) was issued on July 8, 2013 for this application. The appeal period for the determination ended on July 26, 2013. 6. Notice of the public hearing for this application was published in the Tri‐City Herald on August 4, 2013. 7. The proposed amendment bears a substantial relationship to the public health, safety, welfare, and protection of the environment. ---PAGE BREAK--- Staff Report CPA 13-09 8. The proposed amendment is consistent with the requirements of Chapter 36.70A RCW (Growth Management Act). 9. The proposed amendment does not correct an obvious mapping error. 10. The request addresses an identified deficiency in the Comprehensive Plan relating to the City’s lack of Industrial land to meet 20 year goals and population projections. CONCLUSIONS 1. Pursuant to Chapter 4.08 of the Kennewick Municipal Code, the lead agency has determined that the proposed amendment does not have a probable significant adverse impact on the environment. 2. The proposed amendment identifies an area of approximately 2,647 acres to be designated Urban Reserve for Industrial uses. 3. The proposed amendment identifies 8 single‐family lots of totaling approximately 4 acres to be included in the City’s UGA. 4. The proposed amendment identifies 410+/‐ acres for removal from the City’s UGA. 5. The proposed amendment is consistent with the City of Kennewick Comprehensive Plan and will have minimal impact on other aspects of the plan. 6. The proposed amendment will not increase population densities. 7. The City’s existing Capital Facilities Plan is sufficient to address any needs of the 8 lots proposed to be added in the City’s UGA. These lots are part of a subdivision that is already incorporated and were inadvertently excluded from Kennewick’s UGA. Recommendation Staff has reviewed the application and recommends that the Planning Commission concur with the findings and conclusions contained in staff report CPA 13‐09 and recommend approval to City Council.
