Community Planning Department 210 West 6th Avenue Kennewick, WA 99336 Phone: (509) 585‐4280 [EMAIL REDACTED] Mitigation Report Requirements (KMC 18.58.180) When mitigation is required, the applicant shall also submit a mitigation plan, prepared by a “qualified professional”, as defined in KMC 18.58 as part of the critical area report. The goals and objectives will be related to the functions and values of the impacted critical area. See each Critical Area section for specific mitigation requirements. At a minimum, critical area mitigation reports must contain the following (KMC 18.58.180): 1. A description of the anticipated impacts to the critical areas; 2. The mitigating actions proposed and the purposes of the compensation measures, including: - The site selection criteria; - Identification of compensation goals; - Identification of resource functions; - Dates for beginning and completion of site compensation construction activities; 3. A review of the best available science supporting the proposed mitigation and a description of the report author’s experience to date in restoring or creating the type of critical area proposed; 4. An analysis of the likelihood of success of the compensation project; 5. Applicable performance standards identified in the critical area regulations (KMC 18.58 through 18.63); 6. Written specifications and descriptions of the mitigation proposed for construction, such as: - Proposed construction sequence, timing and duration; - Grading and excavation details; - Erosion and sediment control features; - A vegetation planting plan specifying plant species, quantities, locations, size, spacing and density; and - Measures to protect and maintain plants until established. These written specifications shall be accompanied by detailed site diagrams, scaled cross-sectional drawings, topographic maps showing slope percentage and final grade elevations, and any other drawings appropriate to show construction techniques or anticipated final outcome. 7. A Monitoring program in accordance with KMC 18.58.180(4). 8. A Contingency plan in accordance with KMC 18.58.180(5). 9. Financial guarantees in accordance with KMC 18.58.180(6). 10. Other permits. Other local, state, and federal regulatory jurisdictions may require permits for habitat mitigation projects. The applicant shall comply with all other appropriate regulatory permits, agreements, and authority, as required by each respective jurisdiction.
