(Ord. 5046 Sec. 1 (part), 2004: Ord. 3846 Sec. 1 (part), 1999: Ord. 3667 Sec. 1 (part), 1995: Ord. 2496 Sec. 1 (part), 1980: Ord. 2071 Sec. 1 (part), 1977) 15.30.065: Section 113.2 Amended – Schedule of Permit Fees: A fee for new construction and operational fire code permits shall be paid as established in the Kennewick Administrative Code, when such permits are required by Section 105. The Fire Code permit fees authorized in Section 15.30.065 shall be indexed annually by the City Manager to reflect one hundred percent (100%) of any change from the Consumer Price Index (U.S. Cities – Urban Wage Earners and Clerical Workers – CPI-W) for October, or other comparable index if not published. The City Manager shall adjust the permit fees and publish them each December to take effect the beginning of each year. In no event shall the cumulative change in rates or charges be less than zero percent nor more than four percent per year. Unit prices shall be to the nearest cent. (Ord. 5310 Sec. 9, 2010) 15.30.080: Subsection 503.1 - Amended - Fire Apparatus Access Roads: Fire Department access roads shall be provided and maintained in accordance with Section 503 and the Kennewick Administrative Code. (Ord. 5205 Sec. 3, 2007: Ord. 5046 Sec. 1 (part), 2004: Ord. 3846 Sec. 1 (part), 1999) 15.30.090: Subsection 503.2.3 Amended - Surface: Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be provided with a paved, or other pre-approved all-weather driving surface. Exception: Private drives serving not more than two Group R, Division 3, or Group U Occupancies shall meet the minimum requirements of the Kennewick Administrative Code. (Ord. 5310 Sec. 3, 2010: Ord. 5046 Sec. 1 (part), 2004: Ord. 3846 Sec. 1 (part), 1999: Ord. 3667 Sec. 1 (part), 1995) 15.30.110: Subsection 506.3 Added - Approved Key Boxes: The type, installation standards, and maintenance of key boxes shall be in accordance with Section 506 and the Kennewick Administrative Code. (Ord. 5495 Sec. 2, 2013: Ord. 5310 Sec. 4, 2010: Ord. 5046 Sec. 1 (part), 2004) 15.30.180: Subsection 903.4.2 Amended - Alarms: Approved audible devices shall be connected to every required automatic sprinkler system. Such sprinkler water-flow alarm devices shall be activated by the water flow equivalent to the flow of a single sprinkler of the smallest orifice size installed within the system. An exterior alarm device shall be provided at an approved location and interior building notification devices shall be installed throughout the building in accordance with Subsection 907.5. (Ord. 5495 Sec. 3, 2013: Ord. 5310 Sec. 5, 2010: Ord. 5046 Sec. 1 (part), 2004) 15.30.240: Subsection 5601.1.3 Amended - Fireworks: Except as herein provided, it shall be unlawful for any person to store, offer for sale, expose for sale, or use, possess, fire, or discharge any fireworks. The Fire Code Official shall have the authority to adopt reasonable rules and regulations for the granting of permits for supervised public display of fireworks by the municipality, fair association, amusement parks, and other ---PAGE BREAK--- 15.30 - 3 organizations. Every such display shall be handled by a competent operator approved by the Fire Code Official. Every operator shall have first obtained a Washington State Pyrotechnic license pursuant to RCW 70.77 and WAC Chapter 212-17. The display shall be of such a character, and so located, discharged or fired as in the opinion of the Fire Code Official after proper inspection, shall not be hazardous to property or endanger any person. No permit granted hereunder shall be transferable. (Ord. 5495 Sec. 5, 2013: Ord. 5310 Sec. 7, 2010: Ord. 5046 Sec. 1 (part), 2004) 15.30.260: Subsection 5601.1.3.2 Added - Display, Agricultural and Wildlife Fireworks, and Special Effects: No person may sell, discharge, or possess in the City of Kennewick, any of the following except with a permit and in the manner provided by law: "Display fireworks" as defined in RCW 70.77 and WAC 212-17. "Agricultural and wildlife fireworks" as defined in RCW 70.77 and WAC 212-17. "Special effects" as defined in RCW 70.77. “Articles pyrotechnic, special effects for entertainment media” as defined in RCW 70.77. (Ord. 5495 Sec. 6, 2013: Ord. 5310 Sec. 8, 2010: Ord. 5046 Sec. 1 (part), 2004) 15.30.270: Subsection 5601.1.3.3 Added - Authority to Seize Fireworks: Any member of the Kennewick Police or Fire Departments is hereby authorized and empowered to seize, take, remove or cause to be removed, at the expense of the owner, any and all stocks of fireworks offered or exposed for sale, stored, or transported, or held in violation of this article. (Ord. 5495 Sec. 7, 2013: Ord. 5046 Sec. 1 (part), 2004) 15.30.280: Subsection 5601.1.3.4 Added - Insurance Policy: The applicant for a permit for a public display of fireworks shall file with the Fire Department a copy of a public liability and property damage insurance policy providing coverage with minimum limits as specified in RCW 70.77.295; however, the holder of a general license from the chief of the Washington State Patrol, through the director of fire protection, and upon compliance with RCW 70.77.355, shall be excused from compliance with this subsection. Provided, that if the same violator has been found to have committed an infraction violation for the same or similar conduct two separate times, and involving the same or similar sections of the Kennewick Municipal Code, the third ---PAGE BREAK--- 15.30 - 4 or subsequent violation shall constitute a misdemeanor, punishable as provided in KMC 1.12.010. For any violation of a continuing nature, each day's violation shall be considered a separate offense and shall subject the offender to the above penalties for each offense.
