This request is a follow up to Comprehensive Plan Amendment 12-09 (CPA 12- 09) which was approved by City Council on October 2, 2012 by Ordinance 5447. Background This site is owned by the Corporation of the Catholic Bishop Yakima. It is comprised of three separate parcels, each containing one single-family dwelling unit. The homes are used for housing clergy. The applicant has stated that the owner’s intent is to combine these three parcels with two larger parcels that they own abutting to the north. The homes would be demolished and rebuilt. The new homes would still be used as housing for clergy. KMC 18.51.070(2): Findings: Findings Required. In order to amend the zoning map, the City Council must find that the proposed amendment 1conforms with the comprehensive plan and 2promotes the public necessity, convenience and general welfare. Exhibit A ---PAGE BREAK--- Staff Report COZ 12-13 3 1. This proposed change conforms to the Comprehensive Plan Land Use Map. 2. The proposed amendment furthers the public health, safety, welfare, and protection of the environment by allowing these parcels to be combined with two larger parcels allowing for better comprehensive planning of the church campus and there will be no change in uses. Analysis This site is currently used to house the clergy for St. Joseph Catholic Church. The parcels to the north are the sites of the church, church administration building and school. The church would like to combine all of their properties. In order to do so, they must all have the same zoning. This rezone will allow for the combining of all of the properties. The applicant has also stated the owner’s intent to demolish the existing residences and construct three new residences to house clergy. These actions will not create impacts that do not already exist, with the exception of the time period where the residences are being demolished and constructed. Future development will be addressed at the development phase and will be in accord with City standards regarding concurrency, the Kennewick Municipal Code and the State Environmental Policy Act (SEPA). Applicable Goals and Policies of the Comprehensive Plan While there are no specific goals or policies that are applicable to this request, this request will implement the existing Comprehensive Plan land use map designations and will bring the property into conformance with the Comprehensive Plan. Findings 1. The applicant is CKJT Architects (James Taylor, 128 Vista Way, Kennewick, WA 99336). 2. The owner is Corporation of the Catholic Bishop Yakima (5301 Tieton Dr. Ste A, Yakima, WA 98908). 3. The request is to change the zoning from Residential, Medium (RM-6-1) to Residential, High (RH) for 0.54 acres. 4. Kennewick Zoning Matters notification sign #9034 was posted on site January 22, 2013. 5. The application was submitted on November 16, 2012 and was routed for review to various City Departments and other local, state and federal agencies for comment on November 29, 2012. 6. The site is currently served by City sewer and water in W. 5th Ave. 7. Access to the site is currently provided from W. 5th Ave. 8. The proposed amendment is adjacent to Residential, Medium (RM-6-1); Residential, High (RH) Open Space (OS) zoned lands. Exhibit A ---PAGE BREAK--- Staff Report COZ 12-13 4 9. A Determination of Non-Significance (ED 12-78) was issued on December 17, 2012 for this application. The appeal period for the determination ended on January 7, 2013. 10. Notice of the public hearing for this application was published in the Tri-City Herald on January 20, 2013. Notices were also mailed to property owners within 300 feet of the site on January 18, 2013. 11. The proposed amendment furthers the public health, safety, welfare, and protection of the environment by allowing these parcels to be combined with two larger parcels allowing for better comprehensive planning of the church campus and there will be no change in uses. Conclusions 1. Approval will change the zoning for the subject parcel from Residential, Medium (RM-6-1) to Residential, High (RH). 2. Approval will implement the High Density Residential land use designation of the Comprehensive Plan. 3. Approval will not be detrimental to the public necessity, convenience or general welfare. 4. Approval will not result in an increase in adverse environmental impacts. Recommendation Staff has reviewed the application and, finding that it meets the criteria for approving a rezone as contained in KMC 18.51.070, recommends that the Planning Commission concur with the findings and conclusions contained in staff report COZ 12-13 and recommend approval to City Council. Motion I move that the Planning Commission concur with the findings and conclusions in staff report COZ 12-13 and recommend to City Council approval of the request.
