The project is located south of W. Hildebrand Boulevard and east of US 395, 3801 S. Zintel Way. The site is generally flat with the exception of the northern boundary along S. Zintel Way that has some slopes of 12% - 15%. A Preliminary Plat (KMC 17.10) is the first step in subdivision process for subdivisions with more than nine lots or parcels that have been short platted within the last 5 years. A Preliminary Plat is an approval for overall lot layout and compliance with land use regulations. A Final Plat is required for the preliminary plat process and is the last step in the subdivision process and must be recorded prior to the creation of individual lots. Final plat approval is based on the Preliminary Plat conditions of approval. Property History: 1. The subject parcel was annexed into the City in December of 1980 (Ord. No. 2539) with an Agriculture (A-40) zoning designation. 2. In December of 2006 the Comprehensive Plan Land Use Designation was changed from Low Density Residential to Commercial (Res. 07-07). ---PAGE BREAK--- EXHIBIT A-1 Page 3 of 5 3. In March of 2007 the zoning was changed from Agriculture (A-40) to Commercial Community (CC) (Ord. No. 5171). 4. In March of 2008 Short Plat 3085 was approved for the subdivision of an 88.74 acre parcel into 9 lots (SP 07-17). Short Plat 3188 was recorded in March or 2009 amending Short Plat 3085. 5. In April of 2009 a Binding Site Plan was approved to create 3 lots within Lot 8 of Short Plat 3188. One of the lots is the parcel for the subject preliminary plat. Density/Lot Size: Per the Table of Non-Residential Site Development Standards (KMC 18.12.010 B.2) there are no minimum or maximum lot sizes for Commercial Community zoning districts. The smallest proposed lot is .91 acres and the largest lot is 1.37 acres. Zoning regulations for development and Commercial Design Standards will be enforced at the time of Site Plan Review for new buildings to be placed on the parcels and development of lots. Traffic: The City’s traffic engineer has stated that full access can be granted to all lots via the access easement that runs from S. Zintel Way to W. 40th Avenue. A joint access between Lots 1 and 2 may be created if desired for limited access, however the existing median may need to be modified in order to provide for the limitations that would be imposed. The permitted movements from such a driveway and necessary median revisions must be agreed upon with the City Traffic Engineer prior to opening a driveway. Such a driveway would need to be aligned with the driveway across S. Zintel Way. Storm Water: Storm water drainage will be reviewed by the City’s Public Works Department as each lot is developed and will be required to meet the City’s storm water requirements. Streets & Utilities: A separate permit will be required from the Department of Public Works prior to construction for driveways, sidewalks, wheelchair ramps and utility extensions (water, sewer, street, storm drainage, street lights, fire hydrants, etc.). South Zintel Way with utilities has already been constructed along the north side of the plat area, however half street improvements will be required along W. 40th Avenue adjacent to lots 1 and 3. Sidewalks along W. 40th Avenue can be constructed as the lots develop. An existing 12-inch waterline and an existing 21-inch sewer line are available from S. Zintel Way. Lots 1 and 2 are currently served by water and sewer. The developer will be required to extend the existing water line and sewer line to serve lots 3 and 4 prior to final plat approval. Critical Areas: The City’s Critical Area maps show this site contains “Steep Slope” and “Erosion Hazard” Critical Areas. “Steep Slope” Critical Areas are areas with slopes greater than 15% slope. However, per the contour lines shown on the plat map the Steep Slope critical areas are not as extensive as shown on the City’s Critical Area map and it is likely the “Erosion Hazard” areas are also not as extensive. Per KMC 18.62.040 the City’s maps for Steep Slope and Erosion hazard areas are to be used as a guide and can be updated as new information ---PAGE BREAK--- EXHIBIT A-1 Page 4 of 5 becomes available. When the site develops if there are areas of development within Critical Areas a Critical Area Report will be required at the time of development. Parks: Because this subdivision is not in a residential zoning district there are no impacts on the City’s parks and park fees will not be required for this project. Common Area Maintenance: There is an existing property owners association for “Phase Seven at Southridge Village” which includes the subject property. The Phase Seven at Southridge Village property owners association is responsible for all common area maintenance. Schools: The proposed subdivision was routed to Doug Carl of the Kennewick School District for comments. No comments were received and since this is a commercial project it is staff’s opinion that there will be no impact on schools. Surrounding Property: To the north, northeast and southwest is property zoned Commercial Community (CC) and all part of the Phase Seven at Southridge Village development. To the Southeast is the Zintel Canyon flood prevention damn area which is zoned Open Space (OS). Provisions for Public Health, Safety, and Welfare: Based on the above information it is Staff’s opinion that with approval of the Preliminary Plat, appropriate provisions will be made for the Public Health, Safety, and Welfare. Comprehensive Plan: Staff is of the opinion that this request is consistent with and generally conforms to the City’s Comprehensive Plan, and it will implement, goals and policies of the Comprehensive Plan. Particularly the following: URBAN AREA POLICY 3: “Promote new growth consistent with the Comprehensive Land Use Map, the Capital Facilities Plan and the Capital Improvement Plan.” Staff Comment: A commercial development on the subject property is consistent with the Commercial Land Use Plan and Commercial Community Zoning designation. Approving the proposed preliminary plat will help facilitate development of the property. The subject property can be served by City utilities. COMMERCIAL GOAL 2: “Sustain and enhance viable commercial areas.” Staff Comment: The proposed preliminary plat will help facilitate the development of this commercial area. COMMERCIAL GOAL 3: “Create a balanced system of commercial facilities reflecting neighborhood, community, and regional needs.” ---PAGE BREAK--- EXHIBIT A-1 Page 5 of 5 Staff Comment: The proposed Preliminary Plat area is part of a larger area identified for commercial development along the US 395 corridor at the south end of the City. The City of Kennewick hereby RECOMMENDS that Preliminary Plat 11-03 be APPROVED with the following conditions: 1. Comply with City of Kennewick regulatory controls, policies and codes, including the Commercial Design Standards. 2. All fees required by the City shall be paid prior to the approval of the final plat. 3. Development shall be in conformance with the plat drawing date stamped May 5, 2011 (Exhibit A-5). 4. Construct half street improvements on West 40th Avenue with minimum 24’ wide HMA and construct a temporary cul-de-sac around existing bubble adjacent to Lots 1 and 3 including storm water retention for the new half street. 5. A separate permit is required from the Department of Public Works (DPW), prior to construction for driveways, sidewalks, wheelchair ramps and utility extensions. 6. The subject preliminary plat area is to become part of the surrounding Phase Seven at Southridge Village property owners association. 7. Comply with the Public Works memorandum dated June 15, 2011 (Exhibit A-7). 8. Comply with vehicle access per traffic engineer memorandum dated July 28, 2011 (Exhibit A-7). 9. Development of individual lots will require Site Plan Approval and compliance the City’s commercial design standards. 10. Any development or alterations in areas with slopes of over 15% grade will require a Critical Area Report at the time of Site Plan Approval review. 11. A soils report will be required prior to issuance of a building permit for construction of new buildings on the site. Water Quality An NPDES Construction Stormwater General Permit from the Washington State Department of Ecology is required if there is a potential for stormwater discharge from a construction site with more than one acre of disturbed ground. This permit requires that the SEPA checklist fully disclose anticipated activities including building, road construction and utility placements. Obtaining a permit is a minimum 38 day process and may take up to 60 days if the original SEPA does not disclose proposed activities. Erosion control measures must be in place prior to any clearing, grading or construction. These control measures must be able to prevent soilfrom being carried into surface water (this includes storm drains) by stormwater runoff. A stormwater construction permit from Washington State Department of Ecology may be required if there is a potential for discharge from a construction site larger than one acre. A Stormwater Pollution Prevention Plan (Erosion Sediment Control Plan) is needed for all permitted construction sites. KID provides the following comments as a condition of approval by the legislative authority for R.C.W. 58.17.310: 1) Dedicate to KID an irrigation easement 10 feet in width, five (5)feet in width if adjacent to a utility easement, along the road frontage of all lots. 2) A Preliminary Plat review fee of 5150.00 must be paid. 3) As of May L2,2O1.O all subdivisions of land are required to be approved by the KID Board of Directors during a KID Board Meeting. KID Board Meetings are regularly scheduled on the first and third Tuesdays of each month. All conditions must be completed prior to submittal to KID for final approval. The submittal for final approval must be received by KID a minimum of two weeks prior to a regularly scheduled Board Meeting in order to be considered at that meeting.
